A Rhode Island Attorney General report details allegations that a Catholic priest used his access to a young patient at Butler Hospital to begin a pattern of s*xual abuse. The allegations raise serious questions about how vulnerable children were supervised and who was permitted access to them while in institutional care.

For survivors of abuse connected to hospitals, schools, religious organizations, or other institutions, accountability may extend beyond the individual accused of abuse to the organizations responsible for supervision and safety.

On September 30, Massachusetts Attorney General Andrea Joy Campbell released her office's report on child s*xual abuse in the Catholic Dioceses of Worcester, Springfield, and Fall River. The report identifies 275 accused clergy and 944 survivors across the three dioceses.

Much of this abuse can't be criminally prosecuted, either because the conduct wasn't a crime when it happened or because the statute of limitations has expired. Civil options are limited too. Under current Massachusetts law, survivors can file civil claims only until age 53, and the state's charitable immunity cap has been $20,000 since 1971.

Meet Osvaldo “Ozzie” Rocha — Associate Attorney, Calabasas Office

Ozzie is an attorney committed to representing survivors of s*xual abuse and seeking accountability through civil litigation.

His dedication to this work began at Loyola Law School, Los Angeles, where he represented survivors of domestic abuse, labor trafficking, and s*x trafficking through the Immigrant Justice Clinic. There, he helped clients secure legal status in the United States.

At Herman Law, he continues to advocate for survivors of institutional abuse and s*xual assault. Ozzie earned his Juris Doctor from Loyola Law School in 2021 and is admitted to practice in California.

A Mount Vernon youth basketball coach pleaded guilty last week to s*xually abusing a child under 13 over a five-month period. He's expected to serve 18 years in state prison.

Herman Law secured a $4.15 million verdict for a survivor s*xually abused as a 13-year-old by a teacher at a Brooklyn junior high school in 1969. A Kings County jury found the New York City Department of Education fully responsible, nearly 57 years after the abuse occurred.

Meet Arielle Kafker — Appellate Attorney, New York City Office

Arielle is a Research, Writing, and Appeals attorney who brings diverse experience from both trial and appellate courts to her advocacy for survivors of s*xual abuse.

Before joining Herman Law, Arielle served as an Appellate Court Attorney at the Supreme Court of New York, Appellate Division, Second Department, where she wrote reports and drafted opinions for the Justices on civil, criminal, family, and administrative matters. She also clerked for a Superior Court Judge in New Jersey, gaining insight into litigation at the trial level. That combined experience, understanding how cases move through the courts and how judges analyze complex legal issues, makes her a powerful advocate for survivors navigating the legal system.

Arielle earned her Juris Doctor from American University Washington College of Law on a full merit scholarship and served as a Note and Comment Editor on the Administrative Law Review. She continues to do pro bono work for Stand With Us, demonstrating her commitment to fighting for justice and accountability.

This September 11th marks twenty-five years since our nation faced one of its darkest days. Herman Law joins the nation in remembering the lives lost and honoring the courage of the first responders who ran toward danger to save others, reminding us of the best of humanity even in the worst of times. In 2016, three alumnae of Rocky Hill School in Warwick, RI came forward with allegations of s*xual abuse by a former faculty member dating back to the 1970s. Their accounts followed a wave of abuse allegations at other New England prep schools, which led the school to reach out to its community for information.

Rhode Island's revival window, open through June 30, 2028, may give survivors of institutional s*xual abuse a chance to pursue civil claims that had previously expired due to the statute of limitations.
