What should you do after a slip and fall accident in South Florida?

If you’ve been injured, taking the right steps immediately can help protect both your health and your potential claim.

• Seek medical attention promptly. Even if your injuries initially seem minor, some symptoms may not appear right away. Follow your doctor’s recommendations and keep records of your treatment.

• Report the accident. Notify the property owner, manager, or business as soon as possible and request that an incident report be completed. Ask for a copy for your records.

• Document the scene. Take photos and videos of the exact condition that caused your fall, including wet floors, uneven pavement, broken surfaces, missing handrails, poor lighting, and the presence—or absence—of warning signs.

• Gather witness information. If anyone saw the accident or the hazardous condition, collect their names and contact information.

• Be cautious with insurance companies. Avoid giving a recorded statement or accepting a quick settlement before you understand your rights and the full extent of your injuries.

Under Florida premises liability law, property owners and others responsible for a property may have a duty to maintain reasonably safe conditions and warn visitors about certain dangerous conditions. Establishing a claim can depend on proving that a hazardous condition existed, that the responsible party knew or should have known about it, and that the condition caused your injuries.

Florida generally provides two years to file most negligence-based personal injury claims, but exceptions and different requirements can apply depending on the circumstances.

How long do you have to file a car accident claim in Florida?

For most negligence-based personal injury claims arising from accidents on or after March 24, 2023, Florida law generally provides two years from the date of the accident to file a lawsuit under Florida Statute § 95.11.

Importantly, the clock does not generally stop because you are still receiving medical treatment, negotiating with an insurance company, or waiting to see how your injuries develop.

A few important things to know:

• The two-year deadline applies statewide, including throughout South Florida.
• Accidents that occurred before March 24, 2023, may be subject to the prior four-year deadline.
• Limited exceptions may apply, including certain claims involving minors, government entities, or injuries that could not reasonably have been discovered earlier.
• Insurance and PIP requirements are separate from the lawsuit deadline. Seeking medical treatment within 14 days can be important for preserving PIP benefits.
• Waiting can make your case more difficult as evidence disappears, witnesses become harder to locate, and surveillance footage may be overwritten.

After an injury, you may have two main paths to compensation: negotiating an insurance settlement or filing a personal injury lawsuit. Understanding the difference can help you make informed decisions about your case.

Insurance settlements often resolve faster and can avoid the time, expense, and uncertainty of litigation. The process typically involves medical records, bills, a demand for compensation, and negotiations with the insurance company. However, once a settlement is accepted and a release is signed, you generally cannot pursue additional compensation for the same claim.

A personal injury lawsuit becomes an option when a fair settlement cannot be reached. Filing suit does not necessarily mean going to trial. Through discovery, both sides exchange evidence, answer questions, and take depositions, and many cases ultimately settle before a verdict.

Several factors can influence which path makes sense, including the severity of your injuries, available insurance coverage, disputed liability, the strength of the evidence, and the long-term impact of your injuries.

Florida also follows a modified comparative negligence system. If you are found more than 50% responsible for your own injuries, you may be barred from recovering damages.
