Did you know? If you hit a cow on a Montana highway, the rancher usually is not the one who pays.

It comes down to Montana's open range law. Under Montana Code Annotated § 27-1-724, a livestock owner generally has no duty to keep animals from wandering onto highways and cannot be held responsible for a resulting collision unless the owner was grossly negligent or engaged in intentional misconduct. That is a much higher bar than ordinary carelessness.

But the details matter. The rules can be different on certain federal highways and gross negligence claims do exist when an owner's conduct crosses the line. Where the crash happened and what the owner did or failed to do can change everything.

If you have been hurt in a collision with livestock, do not just assume it is your problem to bear. Talk to a lawyer who knows Montana law before you accept that answer.

The U.S. Supreme Court ruled today, 7 to 2, in favor of Monsanto in Monsanto Co. v. Durnell. The decision means people who believe they got cancer from exposure to Roundup can no longer bring a state law claim against Monsanto for failing to put a cancer warning on the product's label.
The Court's reasoning rests on the fact that the EPA has not required Roundup to carry a cancer warning.

It's worth asking how current that EPA review really is. The agency's most recent formal decision on glyphosate dates back to 2020, and a federal appeals court later sent that decision back to the EPA for further review in 2022. In other words, the label protections at the center of this ruling are built on a safety review that is several years old and was already found wanting by a court once before.

This case reaches far beyond Roundup. It affects more than one hundred thousand pending lawsuits nationwide, and it raises bigger questions about what happens when the science and the bureaucracy reviewing it cannot keep pace with one another, and who pays the price when they fall behind.

We will keep watching this issue and what it means for people harmed by products regulators have not taken a fresh look at in years.

The Supreme Court is in its final stretch this term, with decisions expected through the end of June. A few are ones we're watching closely:
(1) Monsanto Co. v. Durnell asks whether federal pesticide law can block state failure to warn claims, a ruling that could reshape tens of thousands of pending Roundup cancer cases and the future of failure to warn claims nationwide.
(2) Montgomery v. Caribe Transport addressing whether freight brokers can be held liable for negligently hiring unsafe truckers, a question that matters every time someone is hurt by a commercial truck. The Supreme Court ruled unanimously (9-0) that federal trucking law doesn't shield freight brokers from negligent-hiring lawsuits, meaning injured victims can now sue brokers under state law for carelessly selecting unsafe carriers.
(3) Chatrie v. United States is a case about geofence warrants and how far law enforcement can reach into our location data, a decision that will ripple into how evidence gets gathered in cases far beyond this one.

We follow the Court because its rulings shape what accountability looks like for injured people.

⚖️ The U.S. Supreme Court heard arguments yesterday in one of the most significant pesticide liability cases in decades. The outcome could eliminate the legal rights of thousands of cancer patients across the country. At the center of it: Roundup, glyphosate, and non-Hodgkin’s lymphoma. Bayer wants the Court to rule that because the EPA never required a cancer warning on Roundup’s label, no state jury can hold them responsible for failing to warn users. If they win, it could wipe out thousands of pending and future claims.

The Court seemed split. Some justices pushed back hard on Bayer’s position. Others seemed receptive to the uniformity argument. A decision is expected by July.

Many Montanans have been exposed to glyphosate as it predominantly impacts farmers, ranchers, and outdoor workers. Yellowstone Law is still reviewing potential claims.
