You're behind a loaded grain truck making a wide turn onto Highway 87, headed to your kid's practice, when it doesn't quite clear the lane and the trailer catches your door.

That truck may not run under the same hours-of-service rules as an interstate semi. Montana farm operations hauling within a 150 air-mile radius are exempt from standard logbook requirements, changing what paper trail exists to document the crash.

What typically survives is different evidence: weigh tickets, maintenance records, DOT inspection reports, dispatch records, fuel receipts, and onboard GPS/telematics data. Most sits at the carrier's office, and critical electronic records or short-term data can be routinely overwritten or cleared within days without a formal spoliation notice.

Call us at 406-888-2222 to request a spoliation letter before short-lived evidence disappears. The rest of the case can wait a day. Preserving that data can't.

You're on your lunch break in the truck when a number you don't recognize lights up your phone. It's the other driver's insurance adjuster, sounding friendly, asking for 'your side of what happened.'

Insurance adjusters routinely ask to record phone calls to capture details about the accident. Whatever you say about who had the right of way or how fast you were going becomes part of a permanent file that can be used against you.

That's why waiting to talk with your own lawyer before answering protects the claim. A recorded guess about fault, made before you've seen the police report or talked to a witness, can't be walked back later. Call us before you pick up that next call: 406-888-2222.

We'll help you figure out what to say, and what to leave for later.

You were riding sh***un, not driving, so the insurance calls feel like the driver's problem to sort out.

A passenger's legal position differs from the driver's in a way that's easy to miss. The driver typically has a cooperation clause with their own insurer, which usually means giving a recorded statement. As a passenger, you're generally not the policyholder on either car's policy, so you typically owe no recorded statement to either driver's insurer.

That matters at a busy Billings intersection this time of year, when it isn't clear yet who had the right of way. A quick answer now can lock you into a version of events before anyone's sorted that out.

And get looked at soon. Passenger injuries can take a few days to show up, and waiting can make it more challenging to tie them to the crash.

If you want a second set of eyes before you call anyone back, reach us at 406-888-2222.

The ache in your neck doesn't really show up until day three, when you twist to grab the seatbelt and something locks.

By then, the other driver's insurance company has probably already called. Day one, friendly voice, asking how you're holding up. It sounds like routine paperwork. Whatever you tell them lands in a file, and it lands before your body has finished telling you what's wrong.

You generally have no obligation to give the at-fault driver's insurer a recorded statement. That matters, because some injuries can take days to surface, and how you describe things this morning may not match what a doctor finds next week.

A quick call to us at 406-888-2222 before you talk to them keeps that decision in your hands. Whatever you say next should be something you actually meant to say.

Skid marks fade before the tow truck even loads up. The signal that was stuck on yellow. The ice on the pavement, the sideways rain, none of it waits around for someone to come back and measure it later.

That disappearing evidence quietly decides a lot about a claim. The car's own event data recorder typically holds onto crash data only until later trips overwrite it. By the time anyone goes looking, the actual conditions from that morning are gone.

I've had people tell me, 'I was just trying to get everyone off the road, I never thought about pictures.' Normal reaction. It's also why your own phone, snapped before the tow truck rolls up, can end up being the only record of what the scene really looked like.

The earlier in the case, the more options you have. Call us: 406-888-2222.

You're flagging traffic on a summer resurfacing job when a driver comes through the cones and hits the truck you're standing behind. The foreman's radio is still squawking while you lay injured on the shoulder of the road.

That one crash can become two cases: your workers' comp claim, and a claim against the driver who hit you. Under Montana law, your comp insurer may try to assert a lien on whatever you recover from that driver. However, just because the insurer is asserting a lien against your recovery does not necessarily mean you have to pay.

Under Montana law, a worker's compensation insurer's lien is subject to the 'Made Whole' rule. Simply stated, if you have not been made whole after the accident, the insure's lien may be improper. Don't let the worker's compensation insurer take a lien against your recovery without calling Matt or AJ to discuss why the insurer's lien may be invalid.

The earlier you call in the case, the more options you have. Call us now: 406-888-2222.

Your supervisor pulls you off light duty the same week the insurance company's doctor sends in his report. You never got a copy of what he actually wrote.

Under Montana law, your insurer may send you to a doctor of its choosing for an independent medical exam. That doctor is picked and paid by the insurance company, not by you. His opinion carries weight, but it isn't the final word on your case. If it conflicts with what your treating doctor says, that disagreement gets resolved by the Department of Labor and Industry or the Workers' Compensation Court, not in the exam room.

One visit. That's what your check can hinge on, unless you push back with your treating doctor's written opinion and the records behind it.

If you want a second set of eyes on that IME report, call us: 406-888-2222.
