A new investigation by ProPublica has documented 506 U.S. citizens detained by immigration agents between January 2025 and September 2026, including more than 100 people whose citizenship was questioned by federal agents.

Among those detained were at least 70 children and teenagers. The investigation also identified cases of U.S. citizens being deported, including Texas-born Brian Morales Garcia.

More than 300 citizens were detained after allegedly assaulting or obstructing federal agents, but fewer than half were ultimately charged in federal court.

U.S. citizenship does not eliminate the risk of being detained by immigration enforcement. Regardless of immigration status, everyone in the United States has constitutional protections against unreasonable searches and seizures and the right to due process.

These findings raise serious questions about accountability, civil rights, and the consequences of increasingly aggressive immigration enforcement.

ICE arrested more than twice as many children between January and July 2026 as it did during the same period in 2025.

According to a new investigation by The Marshall Project, published in partnership with The Guardian, more than 8,500 children have been arrested by ICE and more than 8,750 have been detained since Trump returned to office.

Some children have been held in hotels and temporary facilities where their own families and attorneys struggled to locate them. Others have faced prolonged detention, inadequate conditions and separation from loved ones.

These are children. Many have lived in the United States for years, attended our schools and built their lives in our communities.

Immigration enforcement does not justify denying children dignity, safety or access to legal protections.

The NYPD has released preliminary findings regarding the October 8 shooting of 28-year-old Oscar Belgal by ICE agents in New York City.

According to the NYPD:

• ICE agents were conducting a targeted immigration enforcement operation when they approached Belgal’s vehicle, where a 5-year-old child was also present.

• Surveillance footage shows one plainclothes officer approaching the driver’s window with his gun drawn while another approached the front of the vehicle.

• The vehicle began moving forward and exited the camera’s view. The shooting was not captured on surveillance footage.

• At least one ICE agent fired seven rounds, striking Belgal in the neck below his left ear.

• Responding NYPD officers found Belgal handcuffed and seated on the ground. They provided aid and transported him to a hospital, where he arrived in stable condition.

• The child was later located safe with a family member.

• The NYPD confirmed it had no involvement in the federal operation or the shooting.

Federal authorities have since taken over the investigation.

Belgal has a prior criminal conviction and a separate pending charge. Neither a criminal history nor immigration status eliminates a person’s constitutional protections or automatically justifies deadly force.

The investigation remains ongoing. We will continue sharing updates as more information becomes available.
