CASE UPDATE | Wilber Rafael Garcés Pérez

📌WHAT HAPPENED
On Sunday, September 20, Wilber Rafael Garcés Pérez, a 28-year-old from Venezuela, was shot by an ICE officer in North Austin while making deliveries as a DoorDash driver. According to his attorney, he entered the U.S. legally in 2024 through the CBP One app, applied for asylum, and had a valid work permit. He was taken to the hospital with a gunshot wound to the torso and, within hours, was transferred to the South Texas ICE Processing Center in Pearsall, more than 100 miles from Austin.

📌LATEST UPDATES
🏥 After losing mobility and sensation on his left side, Wilber was taken back to the hospital. He has since returned to detention.
⚠️ According to his attorney, a bullet remains lodged near his spine, and there is concern about possible paralysis or continued loss of mobility.
⚖️ A federal judge issued an emergency order that, for now, prevents his deportation and requires that he appear before the court.
🔍 The officer involved has been placed on administrative leave. The exact circumstances of the shooting remain under investigation, and DHS and Wilber’s legal team have given conflicting accounts, including about the medical care he received while in custody.

We stand in solidarity with Wilber, his family, and everyone in our community experiencing fear, concern, or uncertainty after this incident. Our community deserves transparency, answers, and a complete and impartial investigation. Every person, regardless of country of origin or immigration status, deserves dignity and respect for their rights.

We will continue to follow verified information and official updates in this case.
