in daily from across the network, ensuring the database is constantly

The estates of four family members who were killed in a quadruple homicide sued two healthcare providers, alleging they failed to submit a required firearm prohibition notification after treating the shooter, who had a documented history of mental illness and prior involuntary commitment.

The jury found that the healthcare providers failed to maintain adequate policies and oversight for submitting the required “gun forms,” and that this failure was a substantial factor in the deaths.

A Philadelphia jury awarded the plaintiffs $39.5 million, including $9.5 million in compensatory damages and $30 million in punitive damages. One healthcare provider was found responsible for 35% of the compensatory damages and all punitive damages, while the other had previously settled.

Our latest CaseMetrix Litigation Intelligence report explores how the language used to describe a head injury can influence settlement outcomes.

Using CaseMetrix AI™ and our proprietary settlement and verdict database, we analyzed brain injury cases ranging from headaches and concussions to traumatic brain injuries (TBIs). One finding stood out: cases where "TBI" appeared in the injury narrative saw a dramatic increase in settlement ratios compared to cases described as "closed head injury"—even when medical treatment and overall injury severity were similar.

The takeaway? How an injury is medically documented and characterized may have a meaningful impact on valuation.
