Subsequent to President Biden's decision on Wednesday to drop the Ban (which this litigation was intrumental in forcing him to do), the Government filed a letter with the court wanting the court to dismiss the case in its entirety. Last night we filed a letter with the court opposing that position as completely wrong (it is neither a motion or a report) AND asking the court of a status conference call. Last night the goverment also filed a Motion asking the court to decide the issue of mootness (the case is over because the ban is over (which it is not)). WE have four days to respond to that Motion and we will do so during that time frame.

We attach the last two filings here for you to review. Our amended complaint is also pending the judge's acceptance, which goes to the WAIT time for visa, as opposed to the orignal complaint which was about the proclamation and preserving DV2021 numbers. We are waiting on the judge to accept that amended complaint. We will also likely be doing a FB live on this page later today to talk about these issues.

Some news (mostly good) on the Anunciato v. Trump case. First, the judge denied the government's motion to transfer the case to Washington, DC's district court. The judge hinted that the result may be different than the Gomez v. Trump decision in DC from last September: "Significantly, as the court in NAM noted, application of the controlling law developed in the Ninth and D.C. Circuits may mandate different outcomes on the question of the President’s authority under 8 U.S.C. § 1182(f).” We see that as a good sign since the previous cases challenging bans in that court have generally favored the plaintiffs.

The one piece of news that we're not as happy about is that the judge is going to require a hearing before issuing a decision on our motion and it's not going to be until January 22nd. Obviously, we would have preferred it be sooner.

We sued. Again. The Trump administration decided to halt family and employment based immigrant visas because of a concern that unemployment means we must protect the "American" workforce. Let us remind you, Mr. Trump, that these Plaintiffs paid their fees, waited in line, followed your rules and played your game. Apologies. Having some tech issues so we will reschedule. But here’s the update.

The case is called Anunciato v. Trump and was filed in Northern California’s District Court. The government has been served. I’m sending out a link to the revised complaint so you can see the latest version.

We will be filing the TRO motion shortly and then expect a hearing in a few weeks.

We have our initial assignement of a judge.

Hearing will be in a few weeks.

Our first Weekly Zoom call for our plaintiffs will be on Tuesday at 7 eastern time. Look for an invitation to come by email shortly. We are still adding people to our database so if you officially joined the case after Thursday, you will probably not get your invitation until tomorrow (Monday). Everyone else will get theirs tonight.
