Turner & Turner recently filed suit against Take 5 Oil Change and its parent company, Driven Brands Holdings, Inc over a botched oil change that damaged the vehicle of a Hot Springs woman earlier this year.

In February, the Plaintiff took her car to a Take 5 Oil Change location in Hot Springs for an oil change and routine servicing. Shortly thereafter, the Plaintiff’s vehicle began to experience mechanical problems. When the engine stopped operating, an auto mechanic discovered the vehicle had no oil and showed no signs of any oil leaks.

The Plaintiff, a single mother who works two jobs, has now lost the use of her only vehicle. The Plaintiff initially made a claim with Take 5’s legal department, but Take 5 denied responsibility. Her lawsuit accuses Take 5 of violating the Arkansas Deceptive Trade Practices Act, breach of contract, fraud and negligence.

TURNER & TURNER SECURES $770,000 JUDGMENT
FOR VICTIM OF FRAUDULENT WIRE TRANSFERS

Consumers around the country have lost billions of dollars as the result of sophisticated scams which allowed criminals to wire funds directly from their victims’ bank accounts. Turner & Turner recently secured a judgment for a Little Rock woman who had been victimized after thousands of dollars were stolen from her through fraudulent wire transfers from her personal bank account. Turner & Turner filed suit against the wire transfer recipients and each of the banks which had been involved in the transactions.

Some of the claims were resolved during the course of the two-year lawsuit, but on March 23, 2026 the Pulaski County Circuit Court found the remaining defendants liable and awarded the plaintiff a Judgment for $778,430.74. (Pulaski Circuit No. 60CV-24-3020.)

Turner & Turner encourages you to be cautious and vigilant anytime you are contacted by a stranger about any personal financial matters. You should be wary of answering phone calls from numbers you do not recognize and should not send money or provide any information to anyone that you do not trust. Even if an incoming call appears to be associated with one of your banks, you should contact your bank directly to confirm.

With the return of high school football playoffs, Turner & Turner would like to remind local fans about the Arkansas Activities Associations's ridiculous decision to require everyone to purchase electronic tickets that profit an out-of-state corporation and require fans to forfeit their legal rights, agree to be governed by another state's laws and be burdened by dozens of other unnecessary online terms and conditions simply to go watch a football game at their local public school.

SOLAR LITIGATION UPDATE

On February 11, 2025, Turner & Turner filed a laswuit on behalf of a local resident who had been visited by door-to-door salesmen who made fraudulent representations about the installation of residential solar panels. The lawsuit was filed in Clark County Circuit Court against the comapny which sold the panels, Nivo Solar, and against Solar Mosaic, which financed the transaction.

At the time of the sale, Nivo Solar was performing residential crontracing work without a proper state license. Turner & Turner alleged that these companies had violated the state's Deceptive Trade Practices Act and Home Solicitaiton Sales Act. Both companies responded to the lawsuit by filing motions to compel arbitration.

However, on June 6, 2025, Solar Mosaic filed for bankruptcy relief and Nivo Solar followed suit a few weeks later. As a result of these bankruptcy filings, a stay has been entered which prevents any customers from pursing civil claims against the companies.

In the months since this lawsuit was filed, many residents from around the state have contacted Turner & Turner about similar problems regarding Nivo Solar. Unfortuntaely, the recent bankruptcy filings prevent us from filing any new claims.

Persons who have potential claims against these companies should consider contacting a bankruptcy attorney for advice on participating in those bankruptcy proceedings. Turner & Turner would also encourage anyone who may have incurred losses as a result of deceptive practices or improper home solicitations by Nivo or any other solar provider to file a consumer complaint with the Arkansas Attorney General's Office.

According to the Associated Press, the federal government recently dismissed a lawsuit which had been filed against three of the nation’s largest banks for failing to protect hundreds of thousands of consumers from rampant fraud. The lawsuit, which had been filed by the Consumer Financial Protection Bureau alleged that the banks had failed to enact fraud-prevention measures or to provide assistance to consumers who had lost over $800 million due to fraudulent schemes.

This is a huge victory for huge banks because the government’s lawsuit was dismissed with prejudice, which means it cannot be re-filed. Other cases which were pending against lenders and finance companies have also been dismissed in the past few weeks.

It is becoming almost impossible for American consumers to seek any meaningful, legal relief for financial fraud. Nevertheless, if you have suffered such losses, you should still contact the appropriate federal enforcement or regulatory agencies. That way, there will at least be a record of the activity even if those agencies refuse to take any action to protect the citizens who have been victimized.

The Consumer Financial Protection Bureau is dropping its lawsuit against the company that runs the Zelle payment platform and three U.S. banks as federal agencies continue to pull back on previous enforcement actions now that President Donald Trump is back in office.
