The Trump administration is reportedly preparing to revoke more than 200,000 work and tourist visas held by individuals who used those visas to apply for asylum or are still in the process of doing so.

The anticipated decision would cover all tourist and work visas issued between 2016 and 2026, provided that the visa holders have applied for, or intend to apply for, asylum.

The decision is likely to face legal and judicial challenges later on.

🛑 Important Immigration Update: Traveling with Advance Parole

The BIA recently issued Matter of Delcarmen-Lara, overturning the longstanding Matter of Arrabally rule.

What does this mean in simple terms?

“Unlawful presence” generally means time spent in the U.S. without lawful immigration status or authorized stay. Accumulating more than 180 days of unlawful presence can potentially trigger a 3-year bar, and one year or more can trigger a 10-year bar upon departure.

Under the new BIA decision, traveling outside the U.S. with Advance Parole may now count as a “departure” that triggers these bars.

✅ you have a history of unlawful presence, do not travel on Advance Parole without first obtaining individualized legal advice.

The BIA stated that its new rule applies prospectively, making the timing of travel particularly important.

⚠️ تحديث هام في قانون الهجرة الأمريكي: السفر بإذن Advance Parole

أصدر مجلس استئناف الهجرة الأمريكي BIA مؤخراً قراراً مهماً في قضية Matter of Delcarmen-Lara، ألغى فيه قاعدة قانونية معمولاً بها منذ سنوات.

ماذا يعني ذلك ببساطة؟

الـ Unlawful Presence (الوجود غير القانوني) يعني بشكل عام الفترة التي يقضيها الشخص في الولايات المتحدة دون وضع قانوني أو إقامة مصرح بها.

تراكم أكثر من 180 يوماً من الوجود غير القانوني قد يؤدي عند مغادرة الولايات المتحدة إلى منع من العودة لمدة 3 سنوات، بينما تراكم سنة أو أكثر قد يؤدي إلى منع لمدة 10 سنوات.

وبموجب القرار الجديد، فإن السفر خارج الولايات المتحدة باستخدام Advance Parole قد يُعتبر الآن مغادرة تؤدي إلى تفعيل هذا المنع.

⚠️ لذلك، إذا كان لديك أي فترة سابقة من الوجود غير القانوني، لا تسافر باستخدام Advance Parole قبل استشارة محامي هجرة ودراسة حالتك بشكل فردي.

وقد قرر الـBIA تطبيق القاعدة الجديدة على حالات المغادرة المستقبلية (prospectively)، لذلك فإن تاريخ السفر مهم جداً.

USCIS has issued a new Policy Manual update clarifying that immigration officers may deny a benefit request without first issuing a Request for Evidence (RFE) or Notice of Intent to Deny (NOID) if the applicant, petitioner, or requestor fails to establish eligibility based on the initial filing.

Takeaway: Do not assume USCIS will give you an opportunity to submit missing evidence later. A complete, well-documented filing is more important than ever.

أصدرت دائرة خدمات الهجرة والجنسية الأمريكية (USCIS) تحديثًا جديدًا لدليل السياسات يوضح أن موظفي الهجرة قد يرفضون طلبات المزايا والهجرة دون إصدار طلب تقديم أدلة إضافية (RFE) أو إشعار بنيّة الرفض (NOID) إذا لم يثبت مقدم الطلب أو الملتمس استحقاقه من خلال المستندات المقدمة مع الطلب الأصلي.

Syrian TPS Update – June 2026

Despite the recent U.S. Supreme Court decision, Temporary Protected Status (TPS) for Syrian nationals has not ended.

The Supreme Court returned the case to the federal district court, and the termination of Syrian TPS remains on hold unless and until that court issues a new order authorizing it to take effect.

Accordingly, Syrian TPS beneficiaries continue to have legal authorization to remain and work in the United States at this time, at least until this July 27.

رغم قرار المحكمة العليا الأميركية الأخير، لم يتم إنهاء برنامج الحماية المؤقتة (TPS) للسوريين حتى الآن.

فقد أعادت المحكمة العليا القضية إلى المحكمة الفيدرالية، ولا يمكن إنهاء البرنامج إلا إذا أصدرت تلك المحكمة قرارًا جديدًا يسمح بذلك.

وبناءً عليه، لا يزال السوريون المشمولون ببرنامج TPS يتمتعون بحق الإقامة والعمل في الولايات المتحدة في الوقت الحالي، اقله حتى آخر الشهر في 27 تموز /يوليو .

U.S. Supreme Court Blocks Trump’s Birthright Citizenship Order

The U.S. Supreme Court has ruled that President Trump’s executive order limiting birthright citizenship violates the 14th Amendment. The Court reaffirmed that a president cannot change the Constitution through an executive order. Any change to birthright citizenship would require a constitutional amendment.

اليوم المحكمة الدستورية العليا بتت في مجموعة من الطعون المقدمة ضد ادارة ⁧‫ #ترامب‬⁩، خاصة في موضوع قوانين الهجرة .

‏1- المحكمة اليوم في قرارها، أكدت حق ادارة ترامب بعدم منح اللجوء او التقديم عليه، على الحدود البرية الجنوبية . هذا يشمل من لا يملك فيزا و ريل للحدود فقط.

‏2- للأسف، المحكمة ايدت الغاء قانون الحماية الموقتة TPS لمواطني ⁧‫ #سوريا‬⁩ و هايتي . كانت ادارة ترامب قد أنهت البرنامج في سيبتمبر 2025 ، ثم قامت محكمة فدرالية با ابطال القرار، ومن ثم استأنفت ادارة ترامب القرار، و اليوم ايدت المحكمة الدستورية العليا قرار ادارة ترامب بالإلغاء.

‏يقدر عدد المستفيدين السوريين من ال TPS با 6100 و عدد مستفيدين الهايتي حوالي 350,000.

On June 12, 2026, USCIS filed an appeal to the First Circuit Court of Appeals. However, USCIS also stated that it will comply with the district court’s order while the appeal is pending and will not treat PM-601-0192, PM-602-0194, and PA-2025-26 as effective.
