On May 7, 2026, the U.S. District Court for the Northern District of California in East Bay Sanctuary Covenant v. Trump vacated the DHS circumvention of lawful pathways (CLP) rule, also known as the asylum transit ban. The court reaffirmed its July 2023 merits ruling that the rule is contrary to 8 USC §1158 and is arbitrary, capricious, and procedurally defective.

DHS has announced new consequences for unpaid annual asylum fees. Under the new rule, if the annual fee is not paid within the required timeframe, USCIS may reject a pending asylum application, deny related work permit applications, and existing asylum-based work authorization could be terminated.
