You're at the bottom of the stairs, kid on your hip, and the knee that hit the guardrail gives out. Just for a second. Long enough to notice.

New York makes certain people prove a 'serious injury' before they can sue for pain and suffering; 'serious injury' includes a fracture, a significant disfigurement, or a permanent limitation of a body part. That requirement applies to 'covered persons,' typically people in cars. Motorcyclists aren't covered persons under that law, so you don't have to clear that bar.

The tradeoff: most motorcyclists don't get no-fault medical and wage benefits from their own policy either, since New York's no-fault law excludes motorcycles from that coverage. If a car caused the crash, you may still draw no-fault benefits from that driver's policy. Otherwise, the case runs on proving fault and damages directly.

A permanent limp isn't just an injury. It's the proof a full claim runs on.

August turns the roads linking Saratoga, Albany, Troy, and Schenectady into some of the busiest riding stretches all year. More bikes, more day-trippers unfamiliar with sharing a lane with one, and more crashes on rural stretches where the nearest camera belongs to a farm stand or a brewery, not a business with a security contract.

That footage won't wait for you to ask for it. Retention on those systems can vary widely, often ranging from a few days to several months, depending on the device and whether anyone flagged it before the loop rewrites itself. Then it's gone. A doorbell camera without a subscription can lose everything in about a day, while a commercial system might hold footage for months. You don't know which one you're dealing with until you ask.

Hacker Murphy, LLP Managing Partner John F. Harwick Secures $750,000 Settlement in Dog Attack Case

We are proud to announce that Managing Partner John F. Harwick recently secured a $750,000 settlement for a client injured in a serious dog attack.

This result comes amid a significant change in New York law following the Court of Appeals' landmark decision in Flanders v. Goodfellow, which expanded the rights of dog bite victims by allowing negligence claims against animal owners in addition to traditional strict liability claims.

The settlement reflects both the seriousness of the client's injuries and the growing protections available to victims under New York law.
