Seventy percent isn't a risk. It's a planning requirement.

We insure our homes against fire at a much lower likelihood and never question it. But long-term care β€” the most likely major expense of later life β€” is the one almost nobody plans for. We think it's because a house fire happens to you. Needing care feels like something you'd be admitting. πŸ’™

AI can produce a trust document with perfect formatting, total confidence, and a Florida statute citation that looks completely real. Sometimes it is real. Sometimes the statute was repealed. Sometimes it never existed at all. πŸ‘» And there's no way to tell by looking. The wrong answer and the right answer are formatted identically.

DIY wills have a genuinely great pitch. And the document itself is usually fine! The trouble is ex*****on.

Florida is picky about formalities β€” witnesses, notarization, the self-proving affidavit, the exact language a power of attorney needs before a bank will honor it.

A will that's correct in substance but wrong in procedure isn't a will. It's evidence. πŸ“„ And you find out at the exact moment the one person who could have fixed it isn't around to fix it.

Yesterday: Florida's probate attorney fee runs about 3%.
Today: there are two 3% fees. 😳

The personal representative β€” usually one of the kids β€” is entitled to a commission under a similar schedule.

On a $650,000 estate, that's roughly $19,500 for the attorney and roughly $19,500 for the personal representative. About $39,000 total, before anyone disagrees about anything. And those fees get paid before the beneficiaries get anything.

Nobody is doing anything wrong. That's just what the schedule says. Which is exactly why it's worth planning around it.

Quick math that catches families off guard. 🏑

Florida has a statutory fee schedule for probate β€” roughly 3% of the estate between $100,000 and $1 million. And it's calculated on the gross value. Not what's left after the mortgage.

So if Mom's house is worth $450,000 and she still owes $100,000 on it, the fee math uses $450,000. The mortgage doesn't reduce it. It just gets paid out of what's left.

Nobody's doing anything wrong here. It's just how the statute works β€” and it's a lot easier to plan around it than to discover it.
