Another win!!! My client litigated in good faith the wrongful foreclosure of his home and malicious prosecution against the lenders and servicers but ultimately failed in this case. Defendant, Christiana Trust filed a 57.105 early on in this 4-year-old case. At the original hearing it was denied and Christiana Trust filed a motion for rehearing that was granted. At the re-hearing on Tuesday the Court advised counsel he had read the cross-motions. I decided to go off-script and argue everything from my heart. Judge Tuter said we would have his ruling after the first of the year, but this order came down last night. I WON!!! This saved my client from paying 4-years of Christiana Trust's attorneys' fees and court costs. For a litigator with a heart and the fire to keep on going, don't look past me.
