As discussions continue on the future development and improvement of the civil justice system, it would be beneficial to include perspectives from senior practitioners who practised under both the 1975 Rules and the 2004 CPR.

These attorneys bring with them decades of practical experience and institutional knowledge, having worked through two very different procedural eras in our legal system. Their firsthand insight can offer valuable context on what aspects of the former system functioned effectively, which reforms introduced by the CPR have enhanced the administration of justice, and where ongoing procedural challenges may still exist.

Meaningful reform is often strengthened by balancing innovation with experience. Practitioners who have navigated both systems are uniquely positioned to contribute thoughtful observations on issues such as delay reduction, case management, access to justice, costs, and the practical realities faced daily by litigants and attorneys.

Their voices could provide an important historical and practical perspective in any continuing conversation about the evolution of the civil justice process in Trinidad and Tobago.

We acknowledge the retirement of Justice of Appeal Aboud, whose presence on the Bench will truly be missed.

Justice of Appeal Aboud was known for always trying his very best to mediate matters with fairness, patience and practical wisdom. He approached cases not only from a legal standpoint, but often with a level of common sense and an “outside-the-box” approach that many attorneys and litigants appreciated. During the days of physical court appearances, it was not uncommon for him to leave the Bench to speak directly with the parties and attorneys face-to-face in an effort to resolve issues and encourage understanding. That human approach left a lasting impression on many of us.

It was always a pleasure to appear before him. While our matters sometimes extended far beyond the time they were set down for, there was always meaningful engagement in the courtroom, and we genuinely enjoyed every minute of appearing before him. His ability to connect with people, encourage dialogue and seek practical resolutions made his courtroom unique.

We thank Justice of Appeal Aboud for his years of dedicated service to the Judiciary and wish him continued health, peace and happiness in his retirement. His contribution to the legal fraternity will not be forgotten.

Best wishes to the Honourable Mr. Bereaux J.A. on his retirement from the Court of Appeal. His departure marks a significant loss to the Bench and the wider legal fraternity. He was a distinguished jurist whose wisdom was matched by his dry wit and understated humour. We also remember the compassion he showed when the late Lincoln Nanan, former partner of Nanans Attorneys at Law, collapsed in court, a moment that reflected the humanity behind the office. Wishing him good health, happiness and fulfilment in this well-earned new chapter.

Property owners—take note ⚖️

The Privy Council has ruled that when two people have claims to the same property,
👉 the person who registers first wins.

In this case, a purchaser bought the property, but before their conveyance was registered,
a Deed of Assent transferring the property to the beneficiaries was registered first.

As a result, the purchaser lost the property.

Lesson:
Even if you purchase property, you must ensure your conveyance is registered promptly—
or you risk losing your interest.

The country’s highest court has ruled that the timing of registration of competing interests in property determines which claim takes precedence.
