أصدر المشرّع القطري تعديلًا على قانون مكافحة الجرائم الإلكترونية، بإضافة المادة 8 مكررًا التي تشدد العقوبات على أي شخص يقوم بنشر أو تداول صور أو فيديوهات لأفراد في الأماكن العامة دون علمهم أو موافقتهم.

🔻 العقوبة:
– الحبس لمدة لا تتجاوز سنة
– أو غرامة تصل إلى 100,000 ريال قطري
– أو بإحدى العقوبتين

يهدف هذا التعديل إلى تعزيز الحماية القانونية للفرد في ظل الاستخدام الواسع للهواتف ووسائل التواصل.

من يشملهم قانون العمل… ومن يُستثنى منه؟ ⚖️

تنص المادة (3) من قانون العمل القطري على الفئات التي لا تسري عليها أحكام القانون، وذلك لوجود قوانين خاصة أو طبيعة عمل مختلفة تحكم أوضاعهم الوظيفية.

🔸 الفئات غير الخاضعة لقانون العمل تشمل:
• موظفي الوزارات والهيئات والمؤسسات الحكومية
• شركات البترول والكيماويات والبتروكيماويات
• ضباط وأفراد القوات المسلحة والشرطة
• العاملين في البحر
• العمالة المنزلية
• أفراد أسرة صاحب العمل المقيمين معه
• بعض فئات العمال في الزراعة والرعي

كما يجيز القانون لمجلس الوزراء، بناءً على اقتراح الوزير، تطبيق بعض أحكام قانون العمل على فئات محددة.

Who Is Exempt from Qatar’s Labour Law? ⚖️

Article (3) of Qatar’s Labour Law specifies several categories of individuals who are not governed by the provisions of the Labour Law due to special regulations or the nature of their employment.

🔸 The exempt categories include:
• Employees of ministries and government entities
• Employees of petroleum, petrochemical, and related state-owned companies
• Armed forces, police, and military personnel
• Seafarers
• Domestic workers (drivers, nannies, cooks, gardeners, etc.)
• Family members of the employer residing with and supported by them
• Certain agricultural and livestock workers

The Council of Ministers may also apply some Labour Law provisions to specific categories based on recommendations from the Minister.

التنمر الإلكتروني… جريمة يعاقب عليها القانون القطري ⚖️

رغم أن التشريع القطري لا يضع تعريفًا مباشرًا لكلمة التنمر الإلكتروني، إلا أن هذا الفعل يندرج قانونيًا تحت الجرائم الإلكترونية وفقًا للقانون رقم (14) لسنة 2014.

🔸 ما الذي يشمله التنمر إلكترونيًا؟
• عبارات السب والقذف عبر منصات التواصل
• التعدي على الخصوصية بنشر البيانات أو الصور دون إذن
• تزييف الصور أو تداولها بقصد الإساءة

🔸 ما العقوبات؟
وفق المادة 8:
الحبس لمدة تصل إلى 3 سنوات وغرامة تصل إلى 100,000 ريال.

وفق المادة 8 مكرر:
الحبس لمدة تصل إلى سنة وغرامة تصل إلى 100,000 ريال عند التعدي على الحياة الخاصة في الأماكن العامة.

هذه المواد تغطي بشكل شامل أشكال التنمر عبر الإنترنت، حتى إن لم يُذكر المصطلح صراحة.

📌 في حال التعرض لأي شكل من أشكال الإساءة الإلكترونية، يمكن لمكتب أسماء مفتاح الغانم للمحاماة والاستشارات القانونية تقديم المشورة القانونية ورفع الشكاوى وفق الإجراءات الصحيحة.

Cyberbullying in Qatar… A punishable offense under the Cybercrime Law ⚖️

Although Qatari legislation does not explicitly define the term cyberbullying, such behavior clearly falls under the broader definition of electronic crimes in Law No. 14 of 2014.

🔹 What actions are considered cyberbullying?
• Online insults, slander, or offensive remarks
• Violating privacy by publishing data or images without consent
• Manipulating or sharing photos with the intent to harm

🔹 Penalties under the Cybercrime Law:
• Article 8: Up to 3 years imprisonment and a fine up to QAR 100,000
• Article 8 (bis): Up to 1 year imprisonment and a fine up to QAR 100,000 for violating privacy in public places

Even without mentioning the word “cyberbullying,” the law provides comprehensive protection against all forms of online harassment.
