بینک اسٹیٹمنٹ آمدن کا ثبوت نہیں – سپریم کورٹ کا تاریخی فیصلہ!

اس کیس میں ایف بی آر نے صرف بینک اسٹیٹمنٹس کی بنیاد پر انکم ٹیکس آرڈیننس 2001 کے سیکشن 122(5A) کے تحت ازسرنو اسیسمنٹ کی کارروائی شروع کی۔ ایف بی آر کا مؤقف تھا کہ ٹیکس دہندہ کے بینک اکاؤنٹ میں موجود کریڈٹ انٹریز "Undisclosed Income" ہیں، لہٰذا انہیں نوٹس جاری کیا گیا۔
لیکن ٹیکس دہندہ نے مؤقف اختیار کیا کہ بینک اسٹیٹمنٹس بذات خود "Definite Information" نہیں ہوتیں کیونکہ یہ صرف لین دین کا ریکارڈ ہیں، ان سے براہ راست یہ ثابت نہیں ہوتا کہ یہ آمدن ہے، یا یہ کسی مخصوص ٹیکس ایئر کی آمدن سے متعلق ہے۔
ماتحت عدالت نے ٹیکس دہندہ کے حق میں فیصلہ دیا جسے ہائی کورٹ اور بالآخر سپریم کورٹ نے برقرار رکھا۔
عدالتی فیصلہ:
بینک اسٹیٹمنٹس صرف ایک لین دین کا ریکارڈ ہیں، یہ خود بخود "Definite Information" نہیں بنتیں جب تک یہ مخصوص اور قابل تصدیق شواہد کے ساتھ کسی آمدنی سے واضح تعلق ظاہر نہ کریں۔
عدالت نے مزید کہا کہ "سیکشن 122(5A) کے تحت کوئی بھی کارروائی صرف اسی وقت ہو سکتی ہے جب معلومات واضح، مخصوص اور قابلِ تصدیق ہوں، محض قیاس یا شبہ کی بنیاد پر کارروائی نہیں ہو سکتی۔
اہم نکات: بینک اسٹیٹمنٹ بذاتِ خود "Definite Information" نہیں ہے۔
معلومات کا ٹیکس ایبل آمدنی سے براہِ راست تعلق ہونا ضروری ہے۔
صرف قیاسی یا عمومی معلومات کی بنیاد پر سیکشن 122(5A) کے تحت نوٹس غیرقانونی ہوگا۔
عدالت نے ایف بی آر کا دعویٰ مسترد کرتے ہوئے ٹیکس دہندہ کو ریلیف دیا۔.

پاکستان میں فیملی لاز ایکٹ 1964 میں "ہیگ کنونشن 1980" کے مطابق ایک ترمیم کی گئی ہے۔
اگر شوہر یا بیوی بچے کو دوسرے سے الگ کرتے ہیں اور اسے ملک سے باہر لے جاتے ہیں، تو یہ بین الاقوامی اغوا تصور کیا جائے گا اور حکومت بچے کو اس کے ملک واپس لانے کی پابند ہوگی
