S.R.O. 1355(I)/2026 ⚖️

وفاقی بورڈ آف ریونیو (FBR) نے 7 اگست 2026 کو S.R.O. 1355(I)/2026 جاری کرتے ہوئے انکم ٹیکس آرڈیننس، 2001 کی دفعہ 68(4) کے تحت جاری کردہ S.R.O. 644(I)/2026 مورخہ 16 اپریل 2026 میں مزید ترمیم کی ہے۔

اس ترمیم کے ذریعے Category C Shops, Class-III Shopping Center, E-8 (Naval Headquarters) کے لیے نئی ویلیوایشن انٹریز شامل کی گئی ہیں:

▪️ Ground Shop: Rs. 25,000 فی مربع فٹ
▪️ Back Side Shop: Rs. 22,000 فی مربع فٹ
▪️ Basement Shop: Rs. 11,000 فی مربع فٹ
▪️ Other Floors Shop: Rs. 11,000 فی مربع فٹ
▪️ Blind Basement Shop: Rs. 6,666 فی مربع فٹ
▪️ Flat/Office (Commercial): Rs. 12,000 فی مربع فٹ

یہ ترمیم متعلقہ غیر منقولہ جائیداد کی ٹیکس ویلیوایشن، ٹیکس کمپلائنس اور دیگر متعلقہ ٹیکس معاملات کے لیے اہم ہے۔

📌 2026 PTD 721 | Sindh High Court

The Sindh High Court has clarified an important principle regarding audit selection under Section 177 of the Income Tax Ordinance, 2001.

🔹 Audit selection itself does not create an actionable cause of action.
🔹 A taxpayer cannot ordinarily challenge the audit notice at the threshold stage.
🔹 The statutory audit process provides an opportunity to present explanations and defend the taxpayer’s position.
🔹 Any adverse consequence arising from the final audit order may be challenged through the appropriate statutory remedy.

اہم قانونی اصول:
سپریم کورٹ نے قرار دیا کہ سیکشن 236 کے تحت ایڈوانس انکم ٹیکس اس وقت تک عائد نہیں کیا جا سکتا جب تک ایسا قابلِ شناخت ٹیکس دہندہ موجود نہ ہو جو اس ٹیکس کی ایڈجسٹمنٹ/کریڈٹ حاصل کرنے کا حق رکھتا ہو۔

مختصر خلاصہ:
مقدمے میں ٹیلی کام کمپنی کی جانب سے فرنچائزیز کو فراہم کیے جانے والے یونٹس پر ایڈوانس ٹیکس وصول نہ کرنے کا معاملہ زیرِ غور آیا۔ عدالتِ عظمیٰ نے قرار دیا کہ ایڈوانس ٹیکس کی وصولی لازماً ایسے شناخت شدہ ٹیکس دہندہ سے منسلک ہونی چاہیے جو بعد میں اس ٹیکس کا کریڈٹ حاصل کر سکے۔ جہاں فرنچائزیز اس ٹیکس کا فائدہ حاصل کرنے کی اہل نہ ہوں اور حتمی صارفین لین دین کے وقت قابلِ شناخت نہ ہوں، وہاں سیکشن 236 کا اطلاق نہیں کیا جا سکتا۔

مزید برآں، عدالت نے قرار دیا کہ ایسی صورت میں سیکشن 161 کے تحت ڈیفالٹ اور سیکشن 205 کے تحت نتائج بھی لاگو نہیں کیے جا سکتے۔

🔹 عملی اہمیت:
یہ فیصلہ ان معاملات میں نہایت اہم ہے جہاں سیکشن 236 کے تحت ایڈوانس ٹیکس کی ذمہ داری عائد کی جا رہی ہو، خصوصاً جب اس ٹیکس کا حتمی دعویدار یا قابلِ شناخت ٹیکس دہندہ واضح نہ ہو۔

اہم نکتہ: محض کسی تجارتی لین دین کا وجود، ازخود، سیکشن 236 کے تحت ایڈوانس ٹیکس کی ذمہ داری پیدا نہیں کرتا؛ قانون کے تحت قابلِ شناخت ٹیکس دہندہ اور ٹیکس ایڈجسٹمنٹ کا حق بنیادی تقاضا ہے۔
