In the Philippines, the 1987 Constitution of the Republic of the Philippines remains supreme.

As a general rule:

* The Constitution is above both local statutes and international agreements.
* Treaties and international law may become part of Philippine law, but they cannot prevail over the Constitution.

Under Article II, Section 2 of the Constitution, the Philippines adopts the “generally accepted principles of international law as part of the law of the land.” This is known as the doctrine of incorporation.

However, if there is a conflict:

1. The Constitution prevails.
2. Between a treaty and a statute, Philippine jurisprudence often applies:
* lex posterior rule (later law prevails), or
* efforts to harmonize both if possible.

The Supreme Court of the Philippines has consistently held that international agreements cannot amend or override the Constitution.

A commonly cited principle is:

“No treaty or international agreement may contravene the Constitution.”

So, within the Philippines:

* Constitution → highest
* Then statutes and valid treaties/international obligations, interpreted harmoniously whenever possible.

Under the 1987 Philippine Constitution, Article VI, Section 11:

“A Senator or Member of the House of Representatives shall, in all offenses punishable by not more than six years imprisonment, be privileged from arrest while the Congress is in session…”

The protection is very limited. It does not mean senators can never be arrested while Congress is in session.

Coverage of the privilege from arrest

The privilege applies only when ALL these are present:

1. The person is a Senator or House Representative
2. Congress is in session
3. The offense charged is punishable by not more than six (6) years imprisonment

If the crime carries a penalty of more than 6 years, the senator or congressman may be arrested even while Congress is in session.

Examples

A senator may still be arrested for:

* Plunder
* Graft and corruption
* Murder
* Drug offenses
* Serious estafa
* Other felonies with penalties exceeding 6 years

because these crimes exceed the constitutional limit.

Purpose of the rule

The privilege exists mainly to protect the independence of Congress and prevent harassment through minor arrests that could stop legislators from attending sessions.

The same constitutional provision also states that no member shall be questioned elsewhere for speeches or debates in Congress (“speech or debate clause”). That protection is broader regarding legislative acts.
