NOTICE OF DECISION | SSC-G.R. No. 260405

The Court has resolved the Petition for Declaratory Relief concerning the interpretation and consistency of provisions under the 2020 Amended SAMAHAN Constitution and the 2026 SCB Electoral Code.

The Court ruled that the only justiciable issue pertains to the interpretation of Article X, Section 4.2 of the SCB Electoral Code in relation to Article XIV, Section 6(1) of the SAMAHAN Constitution. The remaining issues were dismissed for being outside the scope of declaratory relief.

The Court declared Article X, Section 4.2 of the SCB Electoral Code UNCONSTITUTIONAL for being inconsistent with the Constitution. Accordingly, lone candidates must obtain 50% + 1 of total votes and must surpass abstention votes to be declared winners.

The Temporary Restraining Order is LIFTED, and the proclamation of winners in the 2026 SCB Elections may proceed.

[SSC-G.R. No. 260405] FOR: PETITION FOR DECLARATORY RELIEF with prayer for Temporary Restraining Order

In a petition filed on April 2, 2026, the SAMAHAN Student Court has been urged to review and clarify the provisions of Ateneo de Davao University’s Commission on Elections (AdDU COMELEC) 2026 SAMAHAN Central Board Electoral Code.

The petition contained the student-petitioners' prayer for the issuance of a Temporary Restraining Order on the Proclamation of Winners set forth on April 6, 2026, review of the alignment and constitutionality of Article X Section 4.2 of the 2026 Electoral Code with Article XIV Section 6 (1) and Section 7 of the Amended 2020 SAMAHAN Constitution, nullification of previous proclamation of unqualified lone-candidates in accordance with the Electoral Code, and issuance of a preventive suspension to any organization and individual affiliated with the case from holding any office in the SAMAHAN.

The Court denies the third prayer of the petitioners to shield their names which will be substantiated in a resolution.

The Court resolved to grant the Prayer for Temporary Restraining Order for the Proclamation of Candidates. A full length Resolution will be published later today.
