Global News: The Trump administration, led by Secretary of State Marco Rubio, has imposed sanctions on International Criminal Court (ICC) President Tomoko Akane and senior trial lawyer Abdoulaye Seye under an executive order by President Donald Trump.

Seye is notably part of the prosecution team that sought arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former defense minister Yoav Gallant. The US accuses the court of being corrupt, politicized, and overreaching its mandate by targeting personnel from non-member nations like the US and Israel regarding actions in places such as Afghanistan, Iraq, and Gaza. Washington also cited concerns that the ICC could target US service members involved in immigration enforcement or drug interdiction strikes.

The sanctions freeze any US assets belonging to Akane and Seye, block them from the US financial system, and include a Treasury Department general license allowing a transaction wind-down period through September 17. In response, the ICC stated that the measures jeopardize its existence, threaten the rule of law, and risk the international legal order.

Meanwhile, Netanyahu praised the decision, labeling the ICC a kangaroo court. This step follows prior US sanctions on other ICC officials and is part of a broader diplomatic push encouraging nations to leave the court, which countries like Chad and Venezuela have already done. Resistance to the campaign includes ongoing lawsuits filed against the administration by three ICC judges and multiple human rights organizations alleging illegal measures and constitutional violations.

When a company fails, we blame internal controls and weak risk systems—but what if the real culprit is a breakdown of trust?

As Eric Ofori Kwaah, Esq. points out, you can satisfy every line item in the Bank of Ghana’s Corporate Governance Directive or Act 992 and still watch an institution collapse. Why? Because a code can't force a board to act with integrity when no one is watching.

Global News: Top law firms including A&O Shearman, Latham & Watkins, Clifford Chance, Orrick, and Cleary are advising on 1892 Holdings' acquisition of approximately a one-third minority stake in Liverpool FC from Fenway Sports Group (FSG). The deal values Liverpool FC at over $7 billion, representing a significant increase from FSG’s £300 million purchase price in 2010.

1892 Holdings is managed by investor Amit Bhatia and funded by Bhatia, the Mittal Family Trusts, K5 Sports—a K5 Global fund backed by Amazon founder Jeff Bezos—and EE Capital, the family office of Elaine and Facebook co-founder Eduardo Saverin.

Legal representation is split across several firms to handle the buyers, sellers, and backing investors:

A&O Shearman is representing FSG and Liverpool FC, extending a client relationship established when legacy firm Shearman & Sterling advised FSG's 2010 acquisition. Latham & Watkins is advising 1892, led by partners Ed Barnett, Hector Sants, Nick Luongo, Matt Eisler, and Patrick Mitchell across London and the US. Orrick, led by New York partner Max Cantor, and Cleary are advising K5 Sports and its primary investor, with UK sports boutique firm Northridge, led by partner Ian Lynam, assisting Orrick on local regulatory matters. Clifford Chance is representing EE Capital through private equity partners Eric Schaffer and Neil Barlow, alongside London M&A partner Katherine Moir.

This transaction highlights the growing wave of private capital investments in elite sports, which has generated significant mandates for major law firms. Recent examples include A&O Shearman advising Apollo on its €2.5 billion acquisition of a majority stake in Atlético Madrid, Clifford Chance acting for Velocity Sports Partners in acquiring Espanyol, and Latham advising Apollo on its investment in Wrexham AFC.

A legal dispute has emerged in Ghana over court operations during the official judicial vacation running from August 1 to September 30, as mandated by the High Court Rules, 2004.

The Ghana Bar Association (GBA), led by National President Efua Ghartey, submitted a formal letter to Chief Justice Paul Baffoe-Bonnie following petitions from law firms, including Zoe, Akyea & Co, Dame & Partners, and Sam Okudzeto & Associates.

The GBA argued that the vacation is intended to prevent burnout and that vacation courts traditionally address only urgent interlocutory matters rather than full trials. Emphasizing that lawyer appearance during recess is voluntary, the GBA maintained that courts should not proceed if counsel indicates unavailability, nor should litigants be forced to represent themselves.

The controversy centers on high-profile criminal cases where judges received administrative warrants to sit during the break. Samuel Atta Akyea, defending former Signals Bureau chief Kwabena Adu-Boahene in a GH₵49 million financial loss case, and Godfred Yeboah Dame, representing former Food and Buffer Stock CEO Abdul-Hanan Wahab, both notified the Chief Justice they would not attend court during the recess, arguing that their trials lacked exceptional emergency circumstances.

Despite Atta Akyea's notice, presiding High Court Judge Justice Francis Achibonga ruled that the hearing would proceed on August 17, warning that the accused would be required to cross-examine prosecution witnesses personally if his counsel failed to appear.

In response, Chief Justice Baffoe-Bonnie and Deputy Attorney General Dr. Justice Srem-Sai firmly rejected the positions of the GBA and defense counsel. The Chief Justice asserted that individual lawyer vacation plans cannot override a presiding judge's readiness to sit under an official warrant. Supporting this stance, Dr. Srem-Sai labeled the GBA's position legally baseless, emphasizing that lawyers do not dictate court calendars and warning that judges are fully entitled to proceed with trial dockets if defense counsel fails to attend.
