The issue of instant fines meets the Law... In a recent decision dated 02/01/2026, the Office of the Data Protection Commissioner (ODPC) delivered it's determination in ODPC Complaint no. 1498/2025- Steve O. Omwenga-v- CJ's Ltd--The restaurant was fined KES. 75,000/- for sending promotional messages to the Complainant 3 times without his consent. In the determination ODPC stated that " The Respondent failed to obtain a lawful basis for processing the Complaintant's data for marketing purposes and did not inform him that his data would be used in this way". They termed the processing as unlawful, non transparent, and unfair
