IP ALERT | Delhi High Court declines interim injunction against OpenAI in ANI's copyright suit
In a significant ruling with global implications for AI and copyright law, the Delhi High Court has dismissed ANI Media Pvt. Ltd.'s application for an interim injunction against Open AI OpCo LLC in CS(COMM) 1028/2024, holding, on a prima facie basis, that:
1. The Court is not, at this stage, deprived of territorial jurisdiction merely because OpenAI's training servers are located outside India, since the output is generated and accessed within India.
2. That there was no substantial reproduction of ANI's articles in ChatGPT's outputs, particularly as the illustrations relied upon by ANI post-dated the training cut-off and involved adversarial prompting.
3. That OpenAI's storage of ANI's works for training its LLMs falls within the fair dealing exception under Section 52(1)(a) of the Copyright Act, 1957 and therefore, does not amount to infringement under Section 51.
4. That the balance of convenience and public interest, including the quantifiable nature of ANI's claim, the disproportionate harm an injunction would cause to OpenAI and India's ChatGPT user base, and the potential chilling effect on AI development in India, weighed against interim relief.
