Fair Deal Scheme Agricultural Assets: Key Issues for Irish Farmers.
Introduction
The Fair Deal Scheme can significantly impact agricultural assets and farm succession planning in Ireland.
The Fair Deal Scheme agricultural assets framework continues to present practical and legal challenges for farming families in Ireland. While the structure of the Nursing Homes Support Scheme is well established, its interaction with farmland and succession planning remains complex in practice.

Overview of the Financial Assessment
Under the Fair Deal Scheme, contributions are calculated by reference to both income and assets.
The financial assessment under the Scheme operates as follows:
Income Contribution

80% of assessable income
40% in the case of a couple

Asset Contribution

7.5% per annum of asset value

This includes non-cash assets such as:

the principal private residence
farmland
investment property

A three-year cap applies to the principal residence.

The Fair Deal Scheme can have significant consequences for agricultural assets, farm succession and estate planning for Irish farming families.

Meet the Team: Catherine | Accounts⚖️

Catherine is a valued member of the Lynch Solicitors team, bringing a wealth of experience in legal sector accounting and financial management. A native of Cahir, she has built a strong career in the legal industry, underpinned by over 15 years of experience in bookkeeping and financial operations.

Before joining Lynch Solicitors in October 2022, Catherine spent 15 years with another organisation, where she was responsible for overseeing all aspects of the firm’s financial management. Her role included accounts preparation and maintenance, budgeting, reconciliations, and legal industry–specific financial reporting, ensuring accuracy, compliance, and financial integrity at all times.

Since joining the firm, Catherine has played an important role in strengthening internal financial processes and supporting the wider team. Her in-depth knowledge of the legal sector enables her to contribute effectively to the firm’s financial health, supporting the delivery of high-quality legal services.

Outside of work, Catherine enjoys spending time with her family and keeping fit.

Meet the Team: Roisin | Legal Executive ⚖️

Róisín is a native of Donegal who spent most of her teenage years in the harbour town of Cobh, Co. Cork, before settling in Clonmel, where she has lived for the past number of years.

From a young age, Róisín had a strong interest in the legal sector and was determined to build a career in the field. She studied Legal Studies at Cork College of Commerce, where she gained valuable work experience with S. Donegan & Co. Solicitors. Following her placement, she took up a secretarial role within the firm, working closely with Principal Sally Donegan and gaining hands-on experience in Conveyancing, Probate, and Litigation. Róisín also worked with Simon Kelly, Solicitor, in Cork City, further developing her knowledge and experience in litigation.

Committed to continuing her professional development, Róisín studied Law at Griffith College Cork and intends to complete her degree on a part-time basis. She has also recently completed a Law Society course in Property Services and is the proud holder of a Certificate in Property Law & Conveyancing.

Róisín is delighted to be part of the team at Lynch Solicitors as a support member of the Legal Team. She values the opportunity to learn from the experienced solicitors within the firm and enjoys the variety of work and the constant opportunities to expand her knowledge. She thrives on new challenges and appreciates that no two days are the same.

Outside of work, Róisín enjoys spending time with family and keeping fit.

Meet the Team: Saoirse | Legal Secretary ⚖️

Saoirse is a native of Clonmel, where her early interest in how the law affects everyday life and local communities first began.

She went on to study at the University of Galway, graduating in 2024 with a joint honours degree in Law and History. During her studies, she developed strong research and analytical skills, learning to break down complex issues into clear, practical arguments—an approach she brings to her work every day.

Saoirse joined Lynch Solicitors LLP in early 2025 and has gained experience working with colleagues across several practice areas, particularly probate and conveyancing. She is currently preparing for the FE-1 exams as she works toward qualifying as a solicitor.

Being from Clonmel, Saoirse values the importance of local knowledge and community connections. She takes great pride in being part of a firm that puts clients first and in seeing the positive difference that clear, supportive legal guidance can make.

Outside of work, Saoirse enjoys staying active with regular gym sessions and spending time with friends and family.
