Justice Committee Report on Draft Mediation Bill to be Published on 21st June

June 20, 2012 - The Government Joint Committee on Justice, Defence and Equality is due to publish their report on the general scheme of a Mediation Bill 2012. The report will be launched tomorrow the 21st June in Leinster House. The bill was originally published by the minister on the 1st March 2012 and then went to the committee. “civil proceedings” include commercial proceedings, proceedings in relation to boundary disputes between adjoining landowners and proceedings before a tribunal other than a Tribunal of Enquiry.;



 

“commercial proceedings” include a claim under section 205 of the Companies Act 1963;



 

“dispute” subject to Head 3, means any civil or commercial dispute that could give rise or has given rise to civil proceedings;

GlaxoSmithKline Plc settled almost 25,000 cases over its Avandia diabetes drug in mediation as multidistrict litigation begins to wind down, lawyers told a judge today in Philadelphia.

EVERY GOVERNMENT department should have an arbitration officer to limit legal costs because the State has a reputation of “rarely settling cases until reaching the steps of the court”, the Dáil has heard.
