A child with SEN may struggle with transitions, changes to routine, sensory environments, communication difficulties, emotional regulation, or separation from their primary attachment figure. What looks like “resistance” to contact on paper may actually be anxiety. What looks like “behaviour” may be a child communicating distress.

The court’s role is not simply to ensure a child spends time with both parents. The court must consider that child’s individual needs, welfare, and what arrangements genuinely support them to thrive.

This means evidence matters.

Family court is not about equality between parents. It is about meeting the needs of the child in front of the court.

Every child is different. Every SEN profile is different.
