What happens when a family member changes their will at the last minute, leaving everything to someone they've only just met?

These are the questions raised during a case worked on by James Dimond, head of the elder financial abuse and guardianship disputes team at law firm Moores.

He acted for the family of a 91-year-old man who lived alone in the inner Melbourne suburb of Fitzroy.

The man went into respite care and met a nurse he had never known. Within days, she had bought him a will kit and a document was drawn up leaving everything he owned to her.

Weeks later, the man died.

Was this the elderly man's clear, settled wish, or something else entirely?

What actually happens in an estate planning consultation?

For me, it starts with listening.

Before I recommend anything, I want to understand you — your family, your circumstances, what you own, what concerns you and, most importantly, what you want to achieve.

My initial consultations are complimentary, and there’s a reason for that.

I believe you should have the opportunity to understand your options, ask the questions you really want answered and have things explained clearly before making decisions about something as important as your future and your family.

Sometimes, by the end of our meeting, we know exactly what’s needed and we can get everything underway there and then.

Sometimes there’s something I want to check with my technical team or an SRA-regulated solicitor before we proceed.
