Divorce does not invalidate a Will entirely, but it can affect how gifts and appointments within the Will are treated.

In England and Wales, divorce does not cancel your entire Will. Once the divorce is final, gifts to your former spouse and their appointment as executor or trustee are generally treated as though they had died, unless your Will states otherwise. The rest of your Will remains valid, but who inherits those gifts will depend on its wording.

Probate can involve collecting assets, paying debts, valuing the estate, and distributing the inheritance to beneficiaries.

Dealing with an estate involves more than passing on someone’s belongings. The executor or administrator must identify and value what the person owned, collect or manage those assets, and settle any debts and taxes before distributing what remains. The inheritance is then shared according to the Will, or the law if there is no Will. Probate may be needed before some assets can be dealt with.
