If you have stepchildren, this could catch your family out.

Under UK intestacy rules, if you die without a will, only your biological or legally adopted children automatically inherit. Stepchildren are not included, no matter how long they have been part of your family or how close your relationship is.

If you want your stepchildren to inherit, a will is the only way to make sure that happens.

This comes up more than people expect. Someone is told they will only receive an inheritance if they meet a certain condition, maybe converting to a certain career, staying married, or cutting ties with a partner the family disapproves of

Conditions like this are not automatically enforceable. UK law allows some conditions in a will, but if a condition is designed to control someone’s personal life in a way that goes against public policy, such as restricting who they marry or forcing a change in religion, a court can strike it out. The person can often still inherit even if they never meet the condition

If you are dealing with a will that feels more like control than a gift, you do not have to navigate it alone

If you have a pension, the rules around it are changing and it could affect what your family actually inherits.

From April 2027, most unused pension funds will count as part of your estate for inheritance tax purposes. Right now pensions sit outside your estate. Soon they will not.

This matters if you have built up pension savings you were planning to pass on rather than spend. Without the right planning, more of that money could go to tax than you expect.
