Your Spain Non-Lucrative Visa was denied. That is not the end of the road. It is a deadline.

You usually have one month to file a recurso de reposición, or two months for the court route. Miss that window and you lose the appeal entirely and start again from zero.

Here is what most people get wrong: they read the refusal, assume it is final, and wait. But most denials are not about the money. They are about documents. A health policy with a hidden copay. No proof you stopped working. An unclear source of funds. A flawed criminal-record certificate. Every one of those is fixable inside the window.

The same denial, appealed correctly and on time, is very often recoverable. A lawyer who files these every single day reads your refusal letter, finds the exact legal ground, rebuilds the weak document, and submits before the clock runs out.

The clock starts the day you were notified, not the day you read the letter.

⚖️ THE LAW
Article 61 of Royal Decree 1155/2024 (the new Reglamento de Extranjería) defines the Non Lucrative Visa Spain as exactly that: NON lucrative. You cannot work AT ALL while you hold it.
• Not in Spain
• Not abroad
• Not online
• Not for a single client

🚨 WHAT SPANISH CONSULATES NOW CHECK
• Stripe account still invoicing → DENIED
• PayPal active → DENIED
• US LLC still issuing invoices → DENIED

We have seen Non Lucrative Visa Spain files denied at Los Angeles and Miami consulates this year. Same reason every time.

✅ THE FIX: DIGITAL NOMAD VISA SPAIN (DNV)
If you plan to keep working remotely, the Non Lucrative Visa is not your visa. The Digital Nomad Visa Spain allows remote work for non-Spanish employers and clients, and it can open the door to the 24% flat tax under the Beckham Law.

The rule is simple:
• If your income is PASSIVE → NLV
• If you still WORK REMOTELY → DNV

Here's the detail 👇

🟢 NLV — Non-Lucrative Visa
• €2,400/month passive income (€28,800/year)
• 400% of IPREM
• Pensions, rentals, dividends count
• ZERO work allowed (not in Spain, not abroad, not online)

🟢 DNV — Digital Nomad Visa
• €2,850/month NET (≈€34,200/year)
• You must work remotely for non-Spanish employers/clients
• Opens door to 24% flat tax under the Beckham Law

€28,800 a year. That's the number for Spain's Non-Lucrative Visa in 2026 — and most expat groups are getting the math wrong.

Here's how that number is built:

• 400% of IPREM (the Spanish reference for public income)
• IPREM = €600/month, frozen since 2023
• 600 × 4 × 12 = €28,800/year for one person
• + €7,200/year per dependent (spouse, kid, both)
• Couple alone: €36,000
• Couple + 1 child: €43,200

⚠️ The part most Reddit threads get wrong:
A recent lump sum is NOT automatically rejected. If you sold a house, inherited, or had a clean investment exit and you can prove the trace — it counts.

What does NOT count:
❌ Cash sitting in your account with no traceable origin
❌ Family transfers without contract
❌ Crypto without on-ramp records

No traceable origin → no visa.

And if you work remotely, the NLV is NOT your visa. You're looking at the Digital Nomad Visa (DNV).
