Most people think handing over a key ends the legal conversation. Under the Residential Tenancies Act, it often begins it.

The moment a key changes hands, both parties carry rights they didn't negotiate and can't simply hand back. Landlords retain the right to collect rent, issue proper notices, and apply for above-guideline increases. Tenants retain the right to a maintained unit, protection from unlawful eviction, and due process before anything changes.

Neither party's rights disappear because the other holds the key.

Landlord Notices must be Specific.
Where there is a landlord-tenant dispute in which the landlord served a notice on the Tenant alleging objectionable conduct then the landlord must be specific about the complaint they allege. The failure to provide particulars can make the notice defective.
