“They’re on probation, so we can let them go for any reason.”

It’s one of the biggest misconceptions in the workplace.

Probation does not eliminate an employer’s legal obligations or employees rights.

Before ending employment during probation, ask yourself:

✔️ Is the probation clause enforceable?

✔️ Has the employee had a fair opportunity to demonstrate they can do the job?

✔️ Could the decision involve a protected ground under human rights legislation?

Getting it wrong can turn a routine employment decision into a legal claim.

Whether you’re an employer considering a probationary dismissal or an employee who has been let go during probation, don’t rely on assumptions.

“I’m salaried, so I don’t get overtime.” ❌ Not necessarily.

Many salaried employees still qualify for 1.5× overtime beyond the weekly threshold.

Some roles are exempt, but those exemptions are narrower than most people think.

Even if you are exempt, that isn’t unlimited access to your time. Red flags:
→ 40 hours quietly becomes 55, with no one hired to help
→ Nights and weekends become the expectation.
→ Burnout answered with pizza parties instead of pay
