Registration Process in : A Step-by-Step Guide
Protecting your brand is essential in today’s competitive market. Registering a trademark in Bangladesh gives businesses the legal right to protect their brand identity and prevent unauthorized use.
The trademark registration system in Bangladesh is governed by the Trade Marks Act, 2009 and administered by the Department of Patents, Designs and Trademarks (DPDT).
Below is a practical overview of the trademark registration process in Bangladesh.
1️⃣ Trademark Search (Recommended)
Before filing a trademark application, it is advisable to conduct a search to determine whether any identical or similar marks already exist.
Why it matters:
• Reduces the risk of refusal or objection
• Helps assess the registrability of the mark
• Saves time and costs in the long run
Trademark searches are conducted through the records of the Department of Patents, Designs and Trademarks.
2️⃣ Filing the Trademark Application
The applicant must submit a trademark application to the Registry.

• Applicant’s name and address
• Representation of the mark (word mark or logo)
• Description of goods or services
• Applicable class under the Nice Classification
• Power of Attorney (if filed through a trademark agent)
After filing, the Registry issues an application number and filing date.
3️⃣ Examination by the Registry
The application is examined by the Trademark Office to verify:
• Compliance with legal requirements
• Availability of the mark
• Distinctiveness of the trademark
If any issues arise, the Registry issues an Examination Report (Office Action).
4️⃣ Reply to Examination Report
If objections are raised, the applicant must respond within the prescribed time.
Possible outcomes include:
• Acceptance of the response
• Scheduling of a hearing
• Refusal if objections remain unresolved
5️⃣ Acceptance and Publication
Once the application is accepted, the mark is published in the Trademark Journal issued by the Department of Patents, Designs and Trademarks.
The purpose of publication is to allow third parties to challenge the application if they believe the mark conflicts with their rights.
6️⃣ Opposition Period
After publication, any third party may file an opposition.
• Opposition must be filed within 2 months from publication
• Both parties may submit evidence and attend hearings
• If no opposition is filed, the mark proceeds to registration
7️⃣ Trademark Registration
If the application successfully passes the opposition stage, the Registry issues the Trademark Registration Certificate.
A registered trademark is valid for 7 years from the filing date.
8️⃣ Renewal of Trademark
Trademarks in Bangladesh can be renewed indefinitely every 10 years by paying the prescribed renewal fees.

• Filing to examination: 3–6 months
• Publication and opposition period: 2 months
• Registration: 12–24 months (if uncontested)
