Important Update: New Student Visa Rules from 2 October 2026
The Australian Government has introduced major changes to Student visa subclass 500 and Student Guardian visa subclass 590 applications from 2 October 2026. These changes may affect current students, dependants, and anyone planning further study, travel, or relocation arrangements.
What has changed?
• Most current Student visa holders who want to apply for another Student visa must now lodge the application from outside Australia, unless they meet a limited exemption.
• If you currently hold a Student visa as a dependant and want to become the primary Student visa applicant, you must apply from outside Australia and be offshore when the visa is granted.
• Applicants who are required to lodge offshore must also be outside Australia at the time of visa grant.
• The changes do not affect your current Student visa.
• Current Student Guardian visa holders may still be able to lodge a further Student Guardian visa application while in Australia.
Who may still be able to apply in Australia?
Limited exemptions may apply, including students who need up to 12 additional months to complete their original main course with the same provider, DFAT or Defence-sponsored students, PhD applicants, primary or secondary school students, students progressing to a higher AQF level course, and students affected by provider default.
Changes for family members
Family members can no longer be added through separate subsequent entrant applications in most cases. Eligible secondary applicants must generally apply at the same time and place as the primary applicant. Exceptions may apply for Defence or Foreign Affairs students, eligible Pacific or ASEAN passport holders, certain transitional cases, children born in Australia after commencement, and any other class specified by legislative instrument.
Our advice: Do not make visa, study, travel, or family relocation decisions without first checking how these new rules apply to your circumstances. Timing, course progression, location at lodgement, and family inclusion are now more important than ever.
