From Rigid Protection to Graduated Protection

We are proud to share a new legal analysis published in 999 Magazine, authored by Lawyer Khadeeja Almarzooqi, examining Article 149 of the Civil Transactions Law and the graduated approach to a minor’s legal capacity based on age and the development of understanding and discernment.

The Article allows the court to authorise a minor who possesses discernment and has reached the age of 15 Gregorian years to manage all or part of their assets, provided that their ability to manage those assets in their best interests is established. The court may restrict the authorisation to specific assets or transactions and monitor the minor’s management.

This authorisation does not confer full legal capacity. The validity of the minor’s acts remains limited to the scope of the authorisation, while acts exceeding that scope are subject to the general rules governing persons with limited legal capacity. The guardian or custodian’s duties of monitoring, supervision and oversight continue.

Balance lies at the heart of Article 149: protecting minors’ assets, gradually empowering them to manage those assets, and ensuring stability in transactions.

من الحماية الجامدة إلى الحماية المتدرجة

نعتز بنشر قراءة قانونية جديدة في مجلة 999، بقلم المحامية خديجة المرزوقي، تتناول المادة 149 من قانون المعاملات المدنية وفلسفة التدرج في أهلية القاصر بحسب العمر واكتمال الإدراك والتمييز.

تجيز المادة للمحكمة الإذن للصغير المميز الذي أتم 15 سنة ميلادية بإدارة أمواله كلها أو بعضها، متى ثبتت قدرته على الإدارة وتحقيق مصلحته، مع إمكانية تقييد الإذن بأموال أو تصرفات معينة ومتابعة إدارته.

وهذا الإذن لا يمنح القاصر أهلية كاملة؛ إذ تظل صحة تصرفاته مقصورة على حدود الإذن، ويخضع ما يتجاوزها للقواعد العامة المقررة لناقص الأهلية، مع استمرار واجبات الولي أو الوصي في المتابعة والإشراف والرقابة.

فالتوازن هو جوهر المادة 149: حماية أموال القاصر، وتمكينه تدريجيًا من الإدارة، وضمان استقرار المعاملات.
