We have now come to the end of 2016 and we wish to thank our clients for standing with us throughout the year. We would also like to thank our almighty God who has taken us this far. This year marked our 5th Anniversary and we thank God for the milestone achievement. We are cognisant of the fact that we remained afloat and in existence not because of our wit or prowess but by the grace of God and as such we give thanks and glory to the most high without ceasing.

the partners, associates and staff at TLC would like to wish you merry xmas and a prosperous 2016. we shall be closed from the 21st december 2015 up to the 4th Janaury 2016.

many people have been soliciting my views on the recent amendment to the labour act. the supreme court in the zuva case held that an employment contract can be terminated either by the employee or the employer by giving notice. the judgment was delivered on the 17th July 2015. many employees were negatively affected by the said supreme court judgment. employers had to terminate contracts of employment of several employees on notice.
the government reacted by amending section 12 of the labour act. the amendment in the main provides that all those employees whose contracts of employment were terminated on notice on or after 17th July2015 must be paid a minimum of 2 weeks salary for every served. hence, if for instance an employee had been in the employ of the employer for 6 years he/she will be entitled to package which is equivalent to his salary for 3 months. the package is computed at the employee's current salary.
however, the constitutionality of the section which provides that the amendment will apply retrospectively is doubtful. I foresee a situation whereby employers will challenge the constitutionality of the said section at the constitutional court. however, the current position is that all those employees whose contracts of employment were terminated after 17th July 2015 are entitled to a package which will be computed at the rate: 2 weeks salary for every year served.
