NO WRITTEN CONTRACT? EMPLOYMENT RIGHTS MAY STILL EXIST.

Many employers and employees assume that if there is no written contract, there is no employment relationship. The law does not always agree.

Under Zimbabwean labour law, where a person performs work for another and receives, or is entitled to receive, remuneration, an employment contract may be deemed to exist β€” even if nothing was reduced to writing.

This principle protects workers from exploitation and reminds employers that labour obligations may arise from conduct and practice, not merely paperwork.

A written contract is always advisable, but the absence of one does not automatically extinguish rights and obligations.

If you are uncertain about your employment rights or obligations, seek professional legal guidance.

🀝 Did You Know?

A verbal agreement can be legally binding even if nothing has been signed.

However, when disagreements arise, proving what was agreed can become difficult and costly.

βœ… Protect yourself.

βœ… Keep records of important discussions.

βœ… Reduce agreements to writing wherever possible.

Proper documentation helps prevent misunderstandings and provides certainty when disputes occur.

For assistance with contracts, commercial agreements and legal compliance, seek proper legal guidance.

When adults disagree, the law asks one question:
"WHAT IS BEST FOR THE CHILD?"

The Constitution of Zimbabwe places a child's best interests above all other considerations in matters affecting children.

Whether it is a dispute involving:

βœ” Custody
βœ” Guardianship
βœ” Maintenance
βœ” Access and Contact Rights,

The welfare, safety, education, health and overall well-being of the child must always come first.

Ignoring these duties can result in personal liability, penalties, and legal consequences.

Before accepting a directorship, make sure you understand what the law requires.

You need and must get advice on company law, corporate governance and director responsibilities should you wish to be a Director.

Being a Sunday, we took a moment to reflect on Estate Planning from the Biblical context.

Estate planning is not a modern invention. It is a principle that has existed since biblical times.

Proverbs 13:22 reminds us that:

"A good man leaveth an inheritance to his children's children..."

This verse is not merely about accumulating wealth. It is about stewardship, responsibility and intentional planning for future generations.

The Parable of the Prodigal Son (Luke 15) is, in many respects, an estate planning story. A father distributed a portion of his estate during his lifetime. The son's decisions thereafter determined whether that inheritance became a blessing or a burden. The story teaches that wealth transfer without wisdom can quickly be squandered.

Likewise, when our Lord Jesus Christ was buried, Joseph of Arimathea provided a tomb that had been prepared and set aside in advance. Even in death, provision had been made. Preparation mattered.

These biblical accounts demonstrate a timeless truth: legacy does not happen by accident. It requires foresight, planning and wise stewardship.

Today, estate planning goes beyond writing a Will. It includes protecting family wealth, preserving businesses, creating trusts, appointing capable executors and ensuring that your wishes are respected when you are no longer able to speak for yourself.

Leaving a legacy requires more than assets. It requires planning. It requires proper legal advice.

Civil Marriage vs Customary Marriage – Do You Know the Difference?

One of the most important distinctions lies in the nature of the marriage itself.

βœ… A Civil Marriage is monogamous. A spouse cannot lawfully marry another person while that marriage remains in force.

βœ… A Customary Marriage is potentially polygamous, meaning the law recognises the possibility of more than one wife in accordance with customary law.

Understanding the type of marriage you enter into is important because it can affect inheritance rights, estate planning, property ownership, and family relationships.

Before you say "I do", make sure you understand the legal consequences of your choice. Consult a lawyer if you are not sure and get the confidence to proceed.

Most workplace disputes arise not because the law is unclear, but because the parties do not know what the law says.

For those in the private sector and parastatals, the Labour Act [Chapter 28:01] is the foundation of employment relationships in Zimbabwe. It sets out the rights, obligations, protections, and remedies available to both employees and employers.

Whether you are negotiating an employment contract, facing disciplinary proceedings, or simply seeking to understand your workplace rights, knowledge of the Labour Act is essential.

Know your rights. Understand your responsibilities. Protect your future.
