LEGAL TERM OF THE WEEK: BAIL ⚖️

Bail allows an accused person temporary release while awaiting trial preserving the presumption of innocence.

But it isn't automatic. Courts will deny bail if there's a risk of:
❌ Flight (absconding)
❌ Endangering the public or reoffending
❌ Tampering with evidence or witnesses
❌ Extreme charges (e.g., murder or treason)

Who really owns a Mining Claim in Zimbabwe?

A common misconception is that simply being the first person to peg a mining claim automatically makes you its lawful owner. That is not the legal position under Zimbabwe's Mines and Minerals Act.

Under Zimbabwean mining law, the first person who lawfully pegs a claim and then validly registers it in accordance with the law acquires the legal mining title.While the system is generally based on the principle of “first come, first served,”that protection only extends to a person who has complied with all the legal requirements.

After pe***ng a claim, a prospector must:
• Post the prescribed registration notices.
• Apply for registration within the statutory time limits.
• Comply with all other legal requirements under the Act.

Failure to register the claim within the prescribed period is treated as an abandonment of the claim, meaning any priority gained by pe***ng is lost.

So, who owns the claim?

✔️ If the first pegger complies with the law and successfully registers the claim, they hold the superior legal title.

✔️ If the first pegger fails to register or otherwise does not comply with the statutory requirements, their rights lapse, and another person who lawfully acquires and registers the claim may obtain the legal title.

The key takeaway:

The law does not reward the person who simply arrives first with pegs. It protects the person who follows the legal process and perfects their mining rights.

In short: Pe***ng alone does not create ownership. Lawful registration under the Mines and Minerals Act is what secures legal title to a mining claim.

Can a Small House Inherit? The Truth About Unregistered Customary Unions in Zimbabwe.

The answer isn't as simple as yes or no.

Many people assume that a "small house" automatically has no legal rights after a partner dies. However, Zimbabwean law looks beyond labels and examines the legal nature of the relationship.

If a couple entered into a valid customary marriage, failure to register it does not automatically invalidate the marriage. Registration is important, but the law recognises that an unregistered customary marriage may still have legal consequences.

On the other hand, where there was only cohabitation, the courts may consider whether the relationship qualifies as a civil partnership, taking into account factors such as the duration of the relationship, financial interdependence, shared property, and whether the couple lived together on a genuine domestic basis.

Every case is different, and inheritance rights depend on the facts and the applicable law not on whether someone is referred to as a "small house."

Understanding your legal position before a dispute arises can save time, money, and unnecessary conflict.

The Office of the Master of the High Court of Zimbabwe has called upon all registered executors, administrators, beneficiaries, and interested parties to ensure the finalisation of deceased estates.

Failure to respond within the stipulated timeframe (31 July) may result in the Office taking the necessary legal steps to facilitate the finalisation of the estate in accordance with the law.
