Few important aspects relating to Trusts:

1. A person desiring to set up a Trust must know whether he wants a revocable trust or irrevocable Trust.

2. Property donated and transferred to a Trust ceases to be that of a donor. The property will not be considered in determing the donor's taxable income.

3. Property to be donated to a testamentary Trust remains property of the donor during his lifetime. It is considered in determining his taxable income.

4. It possible that a founder can be a Trustee as well as a beneficiary. A court may consider a Trust as alter ego of the founder if certain circumstances exist

Change of name in Zimbabwe.
Change of name in Zimbabwe is in terms of section 18 of the Births and Deaths Registration Act [Chapter 5:02]. The procedure is as follows:

A person appears before a Notary Public and appends his signature on a Notarial Deed of Change of Name.

A Notice of Change of Name is published in a local newspaper as well as in the Government Gazette.

The Deed is not lodged until the expiry of 14 days from the date of flighting the notice.

Once Deed is registered with the Registrar of Deeds, the erson then takes it to the Registrar of Births and Deaths who will then issue a new birth certificate after being satisfied that all procedures have been met.

A person whose title deed has been lost or destroyed can obtain a replacement from the Registrar of Deeds by lodging an appropriate application and proof that the requisite notice has been published by the lodging Conveyancer.
