Congratulations! You just purchased a piece of land. A large property with a stunning view in the countryside affording fresh air and miles of fertile faming ground in case you venture into agriculture. Years go by and you decide to transfer a part of the land to your niece. Your legal advisor presents that you have to obtain the President's consent (a requirement in section 5 of the Lands Act), amongst other things you need, to transfer part of your land. You're puzzled as to why. After all don't you OWN the land in question?
In land law the term 'owner' of land is used closely to refer to an individual (artificial or natural) who holds title to land. Section 3 of the Lands Act guides us towards an understanding why this is so. Ownership vests in the President. This entails that persons who purchase land only received recognition at law as the legal holders of title to the same land for a particular tenure.
The reason for granting this power to heads of state is to enable them to administer and control land for the common benefit or use (whether directly or indirectly) of the Zambian people. Terms may be held for a period of 99 years, a limit that has its own exceptions.

Compulsory acquisition is the power that state has to posses the property of a private holder. This deprives the holder of property, interests or rights over or in such property. The rationale for giving governments such power is that when they acquire the said land it is for the benefit or interest of the public. This would entail that if a land owner, for instance, held title to a piece of land deemed necessary for public use (infrastructure development, mineral discovery or environmental preservation) the government can step in to acquire the said land even though the holder is unwilling to sell or give up the land.
The Constitution, however, puts a limit to when such power can be used that is to say only when the law provides for it to be used. There are 27 instances listed that Acts of Parliament may permit compulsory acquisition to be used. They range from failure of the holder to pay their taxes when due to when courts order that the sell of property is necessary to satisfy an order it has passed.
It is worth noting that where an owner agrees to sell the property, state bears the obligation to compensate them adequately. Agreements are typically used to stipulate the specifics of compensation but where one is absent the court steps in to determine what adequate compensation should be given to the holder.

Plot Twist in the Courtroom! Who says the truth only comes out when it's supposed to? Sometimes, the most revealing secrets are spilled when you least expect it!

Imagine a car accident case. A witness for the defendant (the person being sued) is on the stand. They're supposed to testify that the defendant was driving safely.
The plaintiff's (the person suing) lawyer, during cross-examination, asks the witness: "You mentioned you were looking at your phone to check a text message right before the crash, didn't you?"
The witness, flustered, admits, "Yes, but only for a second."
The defense lawyer might object, saying this wasn't part of the witness's original story. But the judge would allow it. Why? Because that admission, even though it was "dug out" during cross-examination, is now considered valid evidence. The plaintiff's lawyer can use that one little detail to argue that the defendant's car was speeding, or that the witness's testimony about the defendant driving safely is not reliable. That "plot twist" is now a key part of the case.
