🚛 “Who Gets the Couch?” – A Divorce Story from the Farm 😅
The other day while visiting my parents at the farm, I witnessed what looked like a furniture sale in progress. A truck was loading living room chairs from one of the farm workers’ homes.

Curious, I asked what was happening.

“The couple has separated,” I was told. “They were married under customary law. The chairs are going to the wife.”

And there stood the husband… watching the sofa set begin its new life elsewhere. 🪑🚛

Funny? Yes.
Serious? Very.

When a marriage ends, whether under customary law or a civil marriage, property does not divide itself. During divorce proceedings, the court determines how marital assets are shared.

That includes:
• Movable property (furniture, vehicles, household goods)
• Immovable property (land, houses, farms)
• Other material and financial assets

Before your property becomes a public loading event, make sure your rights are protected.

At Muyatwa Legal Practitioners, we assist clients with professional and strategic property settlement solutions during divorce proceedings, ensuring fairness and legal protection every step of the way.

Divorce may divide a marriage… but it shouldn’t divide you from what you’re entitled to.

Today’s Topic: Deed of Moiety

Did you know that one way to transfer land through conveyancing is by adding your spouse's or children’s names to your title deed? This process creates joint ownership of the property and it's done through what is legally known as a Deed of Moiety.

✅ This allows all listed parties to become co-owners of the property
✅ It helps with succession planning and future inheritance matters
✅ It strengthens family property rights and provides shared security

At Muyatwa Legal Practitioners, we offer comprehensive conveyancing services including the preparation and registration of Deeds of Moiety. Whether you're planning for the future or restructuring your ownership rights, we're here to guide you every step of the way.

Starting the Week with Probate & Succession Insights

When a loved one passes on and leaves behind immovable property such as land, it is important to know the right legal process:

• If they left a Will, you must apply for Letters of Probate from the High Court of Zambia.
• If they did not leave a Will, you will need Letters of Administration from the High Court of Zambia.

Please note: Letters of administration from the Local Court are not sufficient to transfer or sell land that forms part of an estate. Only an Administrator (where there is no Will) or Executor (where there is a Will) with valid High Court authority can legally deal with such property.

NEW MONTH, NEW KNOWLEDGE! 🇿🇲

As we step into this new month, let’s take a moment to explore an important topic from a legal perspective acquiring Zambian citizenship.

Did you know that Zambian citizenship can be acquired in several ways, all governed by the Citizenship Board of Zambia?
• By Birth
• By Descent
• By Registration
• By Bestowal

Key routes for registration include:
- Having a Zambian-born parent
- Being a descendant of a Zambian ancestor
- Being married to a Zambian citizen for at least 5 years
- Being legally adopted by a Zambian citizen
- Holding a residence permit and having 10 years of continuous residency in Zambia

Bestowal is available to former Zambian citizens who lost their citizenship by acquiring citizenship of another country.

If you're unsure about your eligibility or need assistance with the process, our team at Muyatwa Legal Practitioners is here to guide you every step of the way.
