Hooggeregshof Verduidelik Wet oor Spoedoortredings

'n Onlangse uitspraak deur die Wes-Kaapse Hooggeregshof het lig gewerp op wanneer motoriste wettiglik vir spoedoortredings gearresteer kan word – en die antwoord is duidelik: spoedoortreding alleen is nie gronde vir arrestasie nie.

In die saak van Zilwa v LUR vir Vervoer en Openbare Werke (2026) het die Hof bevind dat die arrestasie en aanhouding van 'n bestuurder slegs vir die oorskryding van die spoedgrens onwettig is, selfs waar die spoed ver bo die geplaasde grens is.

Die Hof het sulke optrede beskryf as 'n oormatige inbreuk op persoonlike vryheid en strydig met grondwetlike en strafprosesstandaarde.

Wat die Hof Bevestig het:

• Spoedoortreding is nie 'n Bylae 1-oortreding kragtens die Strafproseswet nie, wat beteken dat dit nie arrestasie sonder 'n lasbrief regverdig nie.

• Arrestasie is nie 'n straf nie – dit is 'n prosedurele stap wat slegs gebruik word om hofbywoning te verseker of ernstige skade te voorkom waar die wet dit toelaat.

• Grondwetlike regte geld te alle tye, insluitend beskerming teen arbitrêre arrestasie en aanhouding. Enige arrestasie moet wettig, noodsaaklik en proporsioneel wees.

• Die aanhouding van motoriste vir verkeersoortredings sonder wettige magtiging is ongrondwetlik, ongeag hoe vinnig hulle na bewering gery het.

Die uitspraak bevraagteken ook algemene handhawingsbenaderings, veral tydens hoësigbaarheidsoperasies, waar arrestasies vir spoedoortredings soms in die openbaar vertoon word.

Die Hof het dit duidelik gemaak dat arrestasie nie as 'n afskrikmiddel of openbare skouspel gebruik kan word nie, en onwettige gedrag kan nie geregverdig word deur operasionele gerief of openbare boodskappe nie.

Wat dit vir motoriste beteken..

Enigiemand wat:

* sonder 'n lasbrief gearresteer is

* in polisieselle aangehou is

* slegs vir spoedoortreding aangehou is

* as 'n misdadiger vir 'n verkeersoortreding behandel is

Motoriste kan regsadvies inwin rakende moontlike siviele eise, insluitend onwettige arrestasie of aanhouding en verwante grondwetlike skadevergoeding.

Verkeershandhawing moet in lyn wees met die Grondwet, die Strafproseswet en gevestigde hofuitsprake.

Die handhawing van die wet is nie opsioneel nie – veral nie vir diegene wat toevertrou is om dit af te dwing nie.

High Court Explains Speeding Act

A recent ruling by the Western Cape High Court has shed light on when motorists can legally be arrested for speeding offences – and the answer is clear: speeding alone is not grounds for arrest.

In the case of Zilwa v MEC for Transport and Public Works (2026), the Court held that the arrest and detention of a driver solely for exceeding the speed limit is unlawful, even where the speed is well above the posted limit.

The Court described such conduct as an excessive intrusion on personal liberty and contrary to constitutional and criminal procedure standards.

What the Court Upheld:

• Speeding is not a Schedule 1 offence under the Criminal Procedure Act, meaning that it does not justify arrest without a warrant.

• Arrest is not a punishment – ​​it is a procedural step used only to ensure court attendance or prevent serious harm where the law permits.

• Constitutional rights apply at all times, including protection against arbitrary arrest and detention. Any arrest must be lawful, necessary and proportionate.

• The arrest of motorists for traffic violations without lawful authority is unconstitutional, regardless of how fast they are allegedly driving.

The ruling also questions common enforcement approaches, particularly during high-visibility operations, where arrests for speeding violations are sometimes displayed in public.

The Court made it clear that arrest cannot be used as a deterrent or public spectacle, and unlawful conduct cannot be justified by operational convenience or public messaging.

What this means for motorists..

Anyone who:

* has been arrested without a warrant

* has been held in police cells

* has been held for a speeding offence only

* has been treated as a criminal for a traffic offence

Motorists can seek legal advice regarding possible civil claims, including unlawful arrest or detention and related constitutional damages.

Traffic enforcement must be in line with the Constitution, the Criminal Procedure Act and established court decisions.

Enforcing the law is not optional – especially not for those entrusted with enforcing it.
