When does a valid claim expire?🕰️

Your right to recover money or enforce a claim is not unlimited. In many cases, the law sets a strict time period within which action must be taken. After that, the claim may prescribe, even if it is otherwise valid.

Knowing when prescription starts running is often just as important as knowing the length of the period.

Prescription periods depend on the facts and the nature of the claim.

If you’re uncertain about your position, getting advice early can prevent costly consequences later.👩🏻‍⚖️

PROPERTY MYTH: “The OTP only becomes binding once the bond is approved.”

❌This is not true.❌

An Offer to Purchase is not “just paperwork.” Once it is signed and accepted, it is a legally binding agreement that creates real rights and obligations, even if the sale is subject to bond approval.

While the agreement may only become fully enforceable once the suspensive conditions are met, signing an OTP already places legal duties on the parties. It is not the same as buying clothing or goods that can simply be returned.

Importantly, once you have signed an OTP, you cannot simply change your mind and refuse to apply for bond approval. In many cases, the agreement allows the seller or the estate agent to apply for bond approval on your behalf if you fail to do so.

Many buyers are also surprised to learn that the Consumer Protection Act cooling-off period does not automatically apply to all property transactions. Property sales are primarily governed by contract law, and in most cases, once you sign, you cannot simply walk away without consequences.

Before signing an OTP:
✔ understand every clause
✔ know exactly what your obligations are
✔ be clear on what happens if a bond is not approved

A short legal consultation before signing can prevent serious stress and financial risk later.

If you think you know what to expect from this trial advocacy course… think again.

Last week I attended the Advanced Trial Advocacy Course presented by Silver Fox Forensics, and it exceeded every expectation I had. Not only did the instructors stretch me far beyond my comfort zone, but they did so in a way that was constructive, intentional, and empowering.

Looking at my facebook memories today, I was reminded of my admission as an attorney 6 years ago.

I had no idea I would go on to be admitted as a conveyancer and as a notary few years down the line. No chance that I would believe you if you said that I would open up my own firm.

The past few days have been absolutely hectic. Minimal sleep, a few moments where I may have snapped at those closest to me, and a lot of stressful phone calls. But all of this because I am fortunate enough to deliver services and get paid for it.

When I left the deeds office this morning after a successful registration, the security guard greeted me. He is ALWAYS nice, ALWAYS helpful, ALWAYS joyful. We always share a joke, and today we had a brief but meaningful interaction and I told him "you always make my day because you are always joyful ". His response "You know that saying - don't look like your problems". We laughed together but on my way back to the office, that hit me so hard.

It made me realise that at the end of the day, it's not the qualifications, the instructions, or the money in your business account that makes you successful. It's whether you made a difference in someone's day. It's whether you have an infectious attitude of not "wearing your problems". Because that's what matters.

Sorry to those who felt me "wearing my problems" lately. I will do better.🤞🏻
