Past medical expenses (for hospitalisation and medical treatment) incurred prior to the matter being settled or finalised in court. FUTURE MEDICAL EXPENSES
Should there be a possibility of you requiring future medical treatment arising from your injuries sustained in the accident, the Road Accident Fund will issue a Section 17 Undertaking. A Section 17 Undertaking is an under

taking by the Fund to pay/settle any of your future medical expenses that are accident related. No actual cash amount is paid by the Fund. LOSS OF EARNINGS
loss of earnings is any income that you have lost, or will lose in the future, due to injuries you suffered as a result of a motor vehicle accident. You are entitled to claim for any money that you would have earned since the motor accident but which you haven’t been able to earn as a result of the accident. Loss of earnings is made up of “past loss of earnings” and “future loss of earnings”.
“Past loss of earnings” is capped at a maximum of R230 000 per year – this figure is adjusted by inflation every 3 months.
“Future loss of earnings” is the estimated amount of income that you will lose as a result of the accident in the future, and is capped at R215 320.00 per year– this figure is adjusted by inflation every 3 months. GENERAL DAMAGES
General damages is compensation for pain and suffering. FUNERAL EXPENSES
Funeral expenses can be claimed by any person who paid the funeral expenses of a person who died in a motor vehicle accident (except a driver who was the sole cause of the accident), subject to that person providing the expense vouchers and payment receipts. LOSS OF SUPPORT
Loss of support can be claimed by a dependent who relied on the deceased breadwinner to support him/her, where the breadwinner died as a result of any negligence of the driver of another motor vehicle. The claim amount is capped at R215 320.00 per year – this figure is adjusted by inflation every 3 month.

Yes. RAF funeral claims can be made for a driver, a passenger or a pedestrian killed in a road accident, provided the person isn’t considered solely responsible for the accident.

You can claim the following funeral-related expenses from the RAF:
• transportation of the body;
• coffin or burial shroud;
• storage, preparation and embalming of the body;
• issuing of the death certificate;
• burial or cremation costs.

However, you can’t claim the following funeral-related expenses such:
• the costs of flower arrangements;
• printed funeral programs;
• transport for family and attendees;
• a headstone;
• catering and venue hire.

A claimant will be required to prove that the accident occurred and that he/she suffered damages due to the accident.

A claimant should therefore take the following steps at the scene of the accident:
• record the location (street name and area) where the accident happened;
• take photographs showing the damage to all vehicles involved in the accident;
• take photographs showing the position of all vehicles involved in the accident;
• record details of the other driver and vehicle involved in the accident, i.e. name, surname, contact number, description and registration number of the vehicle;
• record contact details of any witnesses to the accident;
• if police attend the scene of the accident, record their contact details and the Accident Report number.

YES! - However, a claim can only be settled or go on trial after all required documents are obtained and provided to the Road Accident Fund (“RAF”). These documents include : proof of the accident, proof of medical treatment, proof of damages and the various specialist doctor’s reports.

A settlement offer can be proposed either by the RAF or by your attorney, and either party can respond to the settlement offer by making a counter proposal by the other party.

Your attorney is legally required to inform you of any settlement offer be made by the RAF, and to discuss that offer with you before accepting or rejecting that offer.

No. A driver who drives a motor vehicle without having a valid driver’s license, and who is involved in an accident, is not automatically negligent. The issue of negligence will be determined by the circumstances of the accident, and if an unlicenced driver is injured in an accident that is caused by the negligence of another driver, the unlicenced driver will have a claim against the Road Accident Fund.

It is an established legal principle that: “he who alleges damages must prove those damages”. Therefore, to prove bodily (including brain) injuries, and the financial implications of those injuries, against the Road Accident Fund, a Claimant must attend appointments with various specialist doctors. A list of commonly used specialist doctors are: an Orthopedic Surgeon; Occupational Therapist; Industrial Psychologist and a Neurologist (in the case of a suspected brain injury).

Each specialist doctor will perform a thorough examination of the Claimant, and will prepare a report that will be presented as evidence to prove the nature and extent of injuries, and the financial implications of those injuries, against the Road Accident Fund.

The Road Accident Fund may also require a Claimant to attend appointments with its own appointed specialist doctors.

A claim can only go on trial after the various specialist doctors’ reports are completed and the Road Accident Fund has had an opportunity to assess the reports.

After a claim is lodged with the Road Accident Fund (“the Fund”), the Fund has a statutory obligation to make a settlement offer within 120 days. If the Fund fails to make a settlement offer, the attorney will the draft and issue a Summons against the Fund after the 120-day period expires.

As soon as Summons is served on the Fund, the Fund has 10 court/business days to defend the Summons and thereafter another 20 court/business days to serve and file its plea.

If the Fund fails to defend the Summons, the attorney will take the necessary steps to apply for default judgment against the Fund.

This can be a complicated process. Usually the attorney will request and obtain most of the documents required to process and prosecute a claimant’s claim. However, the attorney may require a claimant’s assistance in obtaining documents in order to expedite the process.

Many departments and institutions require a formal letter of request, accompanied by a power of attorney, proof of claimant’s identification and payment of a prescribed fee before they will release necessary documents.
Where the custodian of documents is un-cooperative (as is sometimes the case with public departments and institutions), it may be necessary for the attorney to file an application in the High Court in terms of the Promotion of Access to Information Act, 2000.
