An antenuptial contract (ANC), also commonly referred to as a prenuptial agreement or prenup, is a legal document in South Africa that individuals may enter into before getting married. This contract outlines the terms and conditions regarding the division of assets and liabilities in the event of divorce or death of one of the spouses.

To create an antenuptial contract in South Africa, it is advisable to consult with a qualified attorney who specializes in family law. The attorney will draft the contract according to the couple's wishes and ensure that it complies with all legal requirements. Additionally, the contract must be signed by both parties in the presence of a notary public.

When going through a divorce, it is common to have many questions about the process and to be overwhelmed with the life changing event. We at FZR Attorneys are here to make the process less overwhelming for you as well as deal with all of your questions. Here are some frequently asked questions (FAQs) when getting a divorce:

1-What are the grounds for divorce?

The grounds for divorce vary significantly with the common disputes being irreconcilable differences, adultery, abandonment, or abuse.

2-How long will the divorce process take?

A divorce can either be an opposed divorce or an unopposed divorce. It can take anywhere from a few months to several years to finalize an opposed divorce.

3-Do I need a lawyer to get a divorce?

While it's possible to navigate the divorce process without a lawyer, it's generally advisable to seek legal advice, especially if there are significant assets, children, or disputes involved. A lawyer can help protect your rights and ensure that your interests are represented.

4-How is property divided in a divorce?

The division of property in a divorce depends on whether the jurisdiction follows community property laws (where marital assets are divided equally) or equitable distribution laws (where assets are divided fairly but not necessarily equally). Factors such as the duration of the marriage, each spouse's contributions, and future earning potential may also be considered.

5-How is child custody determined?

Child custody arrangements are made based on the best interests of the child and are determined based on the individuality of each case. Custody can be joint (shared) or sole (one parent has primary custody).

6-Can the terms of the divorce be modified?

In some cases, the terms of the divorce, such as child custody or spousal support, can be modified if there has been a significant change in circumstances since the divorce was finalized. However, any modifications must be approved by the court.

Before all the excitement and exchanging of vows, there are essential things you need to know to ensure a smooth and legally valid marriage ceremony.

1-If you're considering marriage, it's crucial to take the following steps:

Understand Legal Consequences:
Familiarize yourself with the legal implications of marriage, the type of marital regime that suits you and your partner and the long-term consequences of your selected marital regime.

Comply with Legal Requirements:
Make sure your marriage complies with all legal requirements for validity. This includes giving notice of your intention to marry, obtaining necessary documentation, and following proper procedures for the type of marriage you're entering into.

2-On the day of the marriage ceremony, it is essential for the couple to present the following documents to the officiating person:

Identity Documents:
Each person getting married should provide their valid identity document.

For Marriages Involving a Foreign National and a South African Citizen:
Both partners should present their valid passports.
A completed BI-31 Form (Declaration for the Purpose of Marriage, Letter of no impediment) is required.

For Divorced Individuals:
If either person getting married has been previously divorced, they must provide the final decree of divorce.

For Widowed Individuals:
If either person getting married is widowed, they must present the death certificate of their deceased spouse.

3-Conducting a marriage:

Marriages in South Africa must be conducted by marriage officers authorized under Act No. 25 of 1961.

As for the requirement of witnesses, a marriage ceremony in South Africa must indeed be conducted in the presence of at least two witnesses. This requirement applies regardless of whether the ceremony takes place in:

A church or another building used for religious services.
A public office or private house, provided that the doors are open.

Marriage law in South Africa can be complex, and seeking legal advice or assistance is advisable, especially for specific situations or concerns such as the registration of anti-nuptial agreements and selecting a regime with the accrual system.
By understanding the legal requirements and procedures for marriage in South Africa, you can ensure that your union is legally valid and that you're fully aware of your rights and responsibilities as a married individual. Our offices take pride in ensuring all marital regimes are fully explained and that our clients are aware and content with their preferred marital systems.

Child Custody and Visitation:
Family law addresses matters related to the custody of children, including determining which parent will have physical and legal custody, visitation schedules, and parental relocation. It aims to ensure the best interests of the child are prioritized.

Child Support:
Family law establishes the legal obligation of parents to financially support their children, including guidelines for calculating child support payments based on factors such as income and the child's needs.

Adoption:
Family law governs the process of adopting a child, including requirements for prospective adoptive parents, consent from biological parents, and legal procedures to finalize the adoption.

Paternity:
Family law addresses issues related to establishing the legal parentage of a child, including paternity testing, acknowledgment of paternity, and legal rights and responsibilities of biological fathers.

Domestic Violence and Protective Orders:
Family law provides legal protections for victims of domestic violence, including obtaining protective orders (restraining orders) to prevent further abuse and ensure the safety of family members.

Surrogacy and Assisted Reproduction:
Family law addresses legal issues related to surrogacy arrangements, including contracts between intended parents and surrogate mothers, parental rights, and the legal status of children born through assisted reproduction technologies.

Property and Asset Division:
Family law governs the division of marital property and assets in divorce cases, including real estate, financial assets, retirement accounts, and personal belongings.

Guardianship and Conservatorship:
Family law addresses matters related to guardianship and conservatorship, including appointing guardians for minors or incapacitated adults and managing their personal and financial affairs.

Mediation and Alternative Dispute Resolution:
