Employers, did you know? You can't legally compel an employee to undergo a polygraph test; even if you suspect they have committed a very serious offense. An employee must first consent to the test. The consent can either be incorporated in an employment contract (inserting a clause that compels them to take the test should a need arise and making sure they sign the contract) or it can be obtained by requesting that the employee makes a written declaration, consenting to a specific polygraph test that they are required to take.

Furthermore, should you succeed in getting the consent and the employee does take the test: You cannot find them guilty on the basis that they failed the test only. There needs to be other evidence that corroborates the test results in order for your allegations to hold substance.

Think about this next time you consider firing someone because of their refusal to take a polygraph test or for failing the test. Happy Friday
