Maternity benefits for both parents
TheStar writes that a recent High Court judgment has found the BCEA maternity leave provisions to be unconstitutional, unfairly discriminating between parents, and has ordered that parents must be allowed to share the 4 months' maternity leave provisions as they elect.

This year marks the centenary since the promulgation of the Women Legal Practitioners Act 7 of 1923. As at the end of January 2022 the demographics of attorneys in the country totalled 29 981. Of that number, female legal practitioners were 12 714, which means that female legal practitioners make up 42% of the attorney’s profession (‘Statistics for the attorneys’ profession’ (www.lssa.org.za)). I am extremely proud to be 1 of the 42% of this rewarding and challenging profession. I am grateful for the opportunity to act as a champion of justice and to make a valuable contribution to the growth and transformation of SA's legal system. Happy Women's Day to all the warrior women of SA!

2024 national minimum wage changes
According to BusinessTech the NMW Commission has called for submissions by 8 September on possible changes to the NMW for 2024. The NMW increased by 9,6% on 1 March 2023. The Commission has committed to above inflation increases as the bare minimum.

An up to date Harassment policy is not just a 'nice to have' item. There have been several judgments over the past year under section 60 of the Employment Equity Act, in terms of which employers have been made liable for harassment that has taken place at the workplace, with compensation of up to R300 000 made payable to the victim. Having a harassment policy in place and conducting ongoing awareness programmes, are some of the steps employers need to take to avoid liability under section 60. The Code of Good Practice on the Prevention and Elimination of Harassment in the Workplace that was gazetted last year requires an employer to adopt a harassment policy that substantially complies with the provisions of the Code. This should cover all forms of harassment including racial harassment and bullying, and not just sexual harassment. The Code also requires an employer to conduct ongoing awareness programmes to reinforce and maintain compliance with its harassment policy.

Domestic workers and their employees have new rules to follow in South Africa relating to compensation for injuries or diseases stemming from a place of work.

The Compensation for Occupational Injuries and Diseases Act, 1993 has successfully been amended by Parliament following being assented to by President Cyril Ramaphosa on 6 April.

One of the most important human rights cases of recent decades got underway in the Pretoria High Court on Tuesday, with no fewer than four separate cases challenging Home Affairs Minister Aaron Motsoaledi’s decision to terminate the Zimbabwean Exemption Permit (ZEP) system.

First to the podium was the Helen Suzman Foundation (HSF), represented by Advocate Steven Budlender, which is asking a full bench of three judges to set aside Motsoaledi’s November 2021 decision as unlawful, unconstitutional and invalid.

Average take home pay down 7,5%!!!!

SALabourNews writes about a Citizen report that says the average nominal take-home pay for South Africans of R14,305 in January declined by 7.5% compared to the same period last year, when it had been R15,467.

The BCEA earnings threshold, which creates a dividing line above which various labour laws cease to apply will increase from 1 March 2023.

Labour & Employment Minister Thulas Nxesi has announced a new annual earnings threshold of R241 110 per annum or approximately R20 100 per month from 1 March 2023. The threshold is being increased by 7.6% / R17 000.
