⚖️ National Credit Act case: Advocate Ngcukaitobi addresses alleged SCA errors

During CCT 302/25, National Credit Regulator v National Consumer Tribunal and Others, Justice Ngcukaitobi addressed the Constitutional Court on two alleged errors in the Supreme Court of Appeal’s findings concerning charges for additional services and obligations imposed before the conclusion of a credit agreement.

Cat Matlala trial: The court heard that hospital staff feared Musa Kekana could escape while receiving treatment at Edenvale Hospital. Security measures were introduced, with staff concerned that someone might assist him in leaving the hospital.

⚖️ MYTH VS FACT: Can you stop paying maintenance?

❌ MYTH: “If I’m not seeing my child, I don’t have to pay maintenance.”

✅ FACT: Maintenance and contact are separate legal issues.

In Y.S v C.M [2023] ZAFSHC 117, the High Court confirmed that the duty to maintain a child is not dependent on contact.

If you cannot afford your current maintenance order, apply for a variation rather than simply stop paying.

🚨 SAPS CONFIRMS DISMISSAL OF MAJOR GENERAL FEROZ KHAN 🇿🇦

The South African Police Service (SAPS) has confirmed the dismissal of Major General Feroz Khan following his failure to appear before the designated senior officer for an expeditious disciplinary process. Invoking Regulation 9(7)(b) of the SAPS Discipline Regulations, the police service reiterated that no member, regardless of rank or status, is above the law or organizational accountability frameworks. With legal proceedings ongoing, SAPS stated it will abide by court decisions and share further details as legally permissible.

🚨 Contract killings expose the link between organised crime and politics

At the Madlanga Commission, Dr Mark Shaw highlighted contract killings and assassinations as a clear sign of a well-developed criminal economy, where violence is effectively commercialised.

Shaw said their data has recorded 2,458 assassinations between 2000 and 2025, while this year alone there have been close to 30 incidents of politically motivated killings.

He warned that the growing intersection between politics and organised crime poses a serious threat to South Africa’s constitutional democracy, particularly at local level, where violence can be contracted for political purposes.

Shaw said assassinations were historically concentrated within the ANC, but the latest data shows that political killings are now spread across parties, with the MK Party currently the most targeted in their data.

While assassinations occur across all provinces, KwaZulu-Natal has historically recorded the highest numbers.

🚨 Gqeberha has the third-highest homicide rate among cities assessed

Dr Mark Shaw, Executive Director of the Global Initiative Against Transnational Organised Crime, told the Madlanga Commission that Gqeberha ranks third in the world for homicide rates among the cities for which comparable data is available.

Shaw attributed the high rate to “very vicious and conflictual gang activity”, pointing to the long-term presence of territorially controlling gangs and organised crime in Gqeberha and Cape Town.

🚨 South Africa ranks among the world’s most affected countries by organised crime

Dr Mark Shaw, Executive Director of the Global Initiative Against Transnational Organised Crime, told the Madlanga Commission that South Africa ranks 7th globally for criminality on the Global Organised Crime Index.

Shaw explained that South Africa performs poorly because of the wide range of criminal markets and actors operating across the country, while resilience has remained relatively stable but with some declines.

He said the diversity of organised crime in South Africa is itself part of the problem.

⚖️ Adv Segeels-Ncube identifies key figures in photograph

At the Madlanga Commission, Advocate Lee Segeels-Ncube took the Commission through a photograph, identifying several individuals, including Katiso Molefe, who was arrested on 6 December 2024.

She also identified the late Mr Msibi and explained that the photograph was relevant to a message from Malcolm X stating that Mr Mthethwa “Kinyambose” thanked Lt Gen Godfrey Lebeya for his assistance.

The evidence links the photograph, the individuals identified and the communication involving Malcolm X and Lebeya.
