🚨 Suspended EMPD Chief Commissioner Julius Mkhwanazi is expected to testify before the Madlanga Commission today as investigations into alleged corruption within the metro police intensify.

The commission is probing allegations linked to a 2023 Rosebank operation involving the alleged theft of precious stones worth R14.9 million, as well as claims of unauthorised agreements and the misuse of municipal resources.

Mkhwanazi's testimony follows evidence from Witness K, a former EMPD inspector, who implicated him in several alleged unlawful activities involving police officials and private security operators.

His appearance is expected to shed further light on the allegations currently before the commission.

⚖️ A recent High Court ruling in Mangundhla v South African Reserve Bank (2026) confirmed that Bitcoin can be treated as both "money" and "capital" under South African exchange control laws.

The court also found that transferring Bitcoin to an offshore wallet may amount to exporting capital, which could require regulatory approval.

Justice Madlanga challenged Witness K on her claim that her relationship with Mr Simon was purely work-related, questioning why he would have felt comfortable approaching her with an alleged proposal involving unlawfully obtaining precious stones.

The Chairperson pressed Witness K on what may have led Mr Simon to believe she would be willing to participate in such an arrangement.

Commissioner Khumalo and Adv Baloyi challenged Witness K's version regarding plans to secure a SAP 13 entry for the precious stones.

They put it to her that she intended to have the stones entered into the SAP 13 system before a statement was submitted to IPID, suggesting this could only have been achieved through a fraudulent process. Witness K ultimately conceded that obtaining the SAP 13 entry remained part of her plan at the time.

Commissioner Khumalo put it to Witness K that the alleged SAP-XIII process could only have worked through a fraudulent entry created at a police station, suggesting this would have required corrupting an officer to backdate or falsify records.

He questioned her version of events, saying it did not appear consistent with the WhatsApp evidence and the timeline presented.

Witness K responded that while she understood the commissioner’s explanation, she denied having anyone within the police who could assist with such actions.

Witness K told the commission she brought a man with mining experience into a call to assist with questions around permits for precious stones.

She said the owner admitted he had no permits, after which the stones were taken from the apartment. Under questioning, she was asked whether those involved understood the operation was not lawful, and confirmed the man was not a law enforcement officer or an informer.

The testimony forms part of ongoing in-camera proceedings.
