URA SECURES URGENT VICTORY IN GAUTENG HIGH COURT
In Mupfunguri v Comit Capital (Pty) Ltd (case number: 2026-176298), the Applicant sought urgent relief compelling our client to reinstate a terminated funded trading account and process a disputed payout request. The relief would effectively have required our client to continue performing under a disputed commercial agreement before the contractual dispute had been properly ventilated.
The application was brought on severely truncated time periods, leaving URA effectively two court days to prepare answering papers.
URA’s Director, JP Venter and Associate, Bongiwe Radebe diligently drafted the required pleadings, setting out our client’s position and pointing out the flaws in the Applicant’s case.
On 31 July 2026, the High Court ruled that the Applicant had clearly abused court processes and should never have approached the urgent High Court with a case which was flawed in law. The application was accordingly struck from the urgent roll for lack of urgency, with costs granted in our clients favour.
