Why is it important to have a will.

NOT HAVING A WILL

1.You forfeit the opportunity to decide who inherits what and your Estate is distributed according to South African law. This means people who you may not have wanted to benefit from your Estate may inherit your Estate.

2.Your Partner may be left with nothing if you are not married or your Will is not updated from a previous marriage.

3.Your Children’s inheritance could pass to the Government Guardian’s Fund or appointed Guardian rather than to a Trust that will ensure your wishes for them are carried out.

Deceased Estate matters and Property!

Letter of authority vs letter of executorship.

Both letters are not proof of ownership. You still need a conveyancer to transfer the property.

Letter of authority is issued when estate is less than R 250 000. Issued by the master of the High court or by the magistrates court.
The magistrate court can only issue letters of authority provided that the deceased did not leave a Will.

Please note: You can directly approach the master or the magistrate court to get a letter of authority without the assistance of a lawyer.

Letters of executorship are issued when estate is more than R250 000. You need an attorney to assist you in getting this letter.
Only the master of the high court has powers to issue letters of executorship.

The reason you need an attorney in getting this type of letter is this, the attorney will assist you in administering the estate which include advertising the estate in the newspaper for possible creditors, drafting the liquidation and distribution account etc
