🚨 Harassment & Discrimination: A Workplace Minefield 🚨

Not all workplace discrimination is unfair. For example, giving managers company cars while lower-level employees don’t receive them is discriminatory—but it’s not necessarily unfair. There’s a legitimate reason: retaining management with competitive packages. Similarly, hiring under an affirmative action policy or having separate restrooms for men and women isn’t considered unfair discrimination.

However, when discrimination lacks a legitimate, practical, and logical purpose, it becomes unfair—and the law takes it seriously. The Employment Equity Act classifies harassment as a form of unfair discrimination on various grounds, including race, gender, age, illness, and belief.

A recent case illustrates this:

📌 Case: Padayachee vs Gauteng Department of Education

- Ms. Padayachee, the only employee of Indian descent at her school, was told she needed an assistant due to "language and culture barriers."
- Despite her objections, her superiors continued to criticize her, causing emotional distress and forcing her to seek psychological counselling.
- Her grievance remained unresolved for two years, even after legal intervention.

The Labour Court ruled in her favor, awarding R50,000 in compensation, legal costs, and ordering an investigation into those responsible.

Key Lessons for Employers

❌ You cannot make groundless accusations against employees—especially if they involve race or other protected characteristics.

✅ If faced with an unfair discrimination claim, solid evidence is critical to proving compliance with labour law.

🚨 Failure to act fairly can lead to costly legal battles, reputational damage, and financial penalties.
